Freedom of expression is a universal human right, and it should apply to everyone without any discrimination regarding to their gender, race, religion etc. Thus, freedom of expression and press freedom are regulated both in international and regional human rights instruments. However, Freedom of expression has always been a controversial issue for all states, especially in Turkey. Press freedom plays an important role in the enjoyment and development of all human rights for all members of society. In this regard, press freedom is a condition sine qua non for a democratic society, however, it does not provide unlimited freedom. Specifically, it is one of the non-absolute human rights in the context of the right to freedom of expression. The right may be subject to interference by states for certain conditions such as national security and public safety as indicated in Article 10 of the European Convention on Human Rights. Freedom of the press is one of the main problems that Turkey deals with in the Turkish political process every time. It is a very controversial issue and the issue has kept its popularity termly. However, the Constitution of the Republic of Turkey (1982), Turkish Press Law, Turkish Penal Code and Anti-Terror Law have many provisions relating to the freedom of expression and press freedom. It is also a considerable development for Turkey that, although the European Convention on Human Rights has not given any privilege to press freedom directly, Turkey provided additional protections in its domestic law through these regulations. The dissertation investigated the evolution of freedom of expression and freedom of the press in jurisdiction of the Constitutional Court of Turkey and it‟s interaction with the European Court of Human Rights. For this purpose, this dissertation first examined the concept of the freedom of expression as a universal human right and explored the international human rights instruments, then discussed the freedom of expression and press freedom on the European Court of Human Rights case law. In the second part of the dissertation, freedom of the press regulations regarding to the Turkish domestic law and the approach of the Constitutional Court of Turkey was explored and the Turkish Constitutional Court‟s and the European Court of Human Right‟s approach to the press freedom was comparatively analysed.
