Mediation Directive 2008/52/EC was introduced by the European Union (EU) to meet the growing demands on the judiciary of the member states as the volume of disputes increased along with the growth of the internal markets due to the enlargement of the EU. EU was built on the principle of freedom of movement of people, goods and services, but also as a consequence there was growth in the volume of cross-border disputes. The challenges to the administration of justice in a supranational order, such as being expensive, slow, and cumbersome, have revealed another dimension to dispute resolution that is inherently contentious, ill-defined and irregularly applied. The conceptual development of the first Directive from 1997 onwards led to the promulgation of Directive 2008/52/EC in 2008 to take effect in 2011. Monitoring of its development showed that it was not applied uniformly, nor was very popular with the public in view of its cost and lack of improved time efficiency. Today, general concerns with the administration of justice remain in the background while the arguments are exchanged in support of and against this Directive and the philosophy behind it. While the advantages and disadvantages to the Mediation Directive are discussed in monetary terms, little is spoken about whether the process ensures general order in compliance with the rule of law and prevents exposing EU citizens to arbitrary rule of law. Even though the directive has formalised an informal system, it remains inherently contentious, lacking certitude and regular application. This work draws attention to the relevance and sensitive nature of maintaining a balance between the freedom of movement of people, goods, and services and the equally important grievance processes that minimise ensuing risks to the general administration of justice and their democratic accountability, legitimacy and compliance with rule of law.
