öz HAZAR DENİZİ'NİN STATÜSÜ: SINIRLANDIRMA SORUNU KONUSUNDA BİR ARAŞTIRMA Çevik, Burcu Yüksek Lisans, Uluslararası İlişkiler Bölümü Tez Yöneticisi: Dr. Necati Polat Eylül 1998, 110 sayfa Hazar Denizi enerji kaynakları üzerine yazılmış pek çok eser bulunmakla birlikte, söz konusu enerji kaynaklarının çıkartılması ve dünya pazarlarına ulaştırılması açısından büyük öneme sahip olan Hazar Denizi'nin statüsü konusu yeterince ele alınmamıştır. Bu çalışma Hazar Denizi'nin statüsü konusunu, özellikle konunun hukuki boyutuna ağırlık vererek incelemektedir. Bu çalışmanın amacı, kıyıdaş devletlerin farklı iddiaları karşısında, Hazar Denizi'nde bulunan doğal kaynaklar üzerindeki egemen hakların belirlenmesi açısından uygulanabilecek uluslararası hukuk kurullarını, akdedilmiş olan anlaşmalar, yapılageliş kuralları (teamül), uluslararası hukukun genel ilkeleri, konuyla ilgili davalar ve doktrin çerçevesinde ele almaktır. Bunu yaparken, aynı zamanda, Hazar Denizi'nin statüsü sorunununVI siyasi ve ekonomik boyutuna da eğilinerek sözkonusu problemin ne dereceye kadar hukuki bir sorun olarak görülebileceği de değerlendirilmektedir.

Ill ABSTRACT THE STATUS OF THE CASPIAN SEA: AN INQUIRY INTO THE ISSUE OF DELIMITATION Çevik, Burcu M.S., Department of International Relations Supervisor: Dr. Necati Polat September 1998, 110 pages There is a wide collection of material covering the political aspect of the Caspian energy resources. It seems, however, that the status of the Caspian Sea, in particular the legal aspect of the problem has not received the attention it merits. Despite the significance which the political aspect has, the uncertainty over the status of the Caspian has a negative effect on the utilization of the oil resources by creating tension among the littoral states via disputed oil basins. This thesis aims to fulfill the vacuum through a study of the issue by placing particular emphasis on the legal aspect. It see.ks to analyze the nature of applicable legal norms, if any, with respect to the determination of sovereign rights over the natural resources of the Caspian basin. It aims, therefore, to carry out an investigation of the problem through international conventions, treaties, customary rules of international law, general principles, relevant judicial cases and doctrine. While doing that the political and economic dimension of the problem will beIV handled as well for the purpose of determining whether the status of the Caspian Sea a political or a legal problem. The rules on navigation and environmental protection will not be analyzed because it is possible to assert that the legal status of the Caspian Sea emerges to be a problem not because of fisheries or navigation rights, but because of tension over the utilization of the rich natural resources, especially hydrocarbon resources which is of paramount significance for the economically weak and politically unstable littoral states.
