Özet
12 ÖZET Kadınlara karşı yapılan insan hakları ihlalleri hala tanımlanmayı dolayısıyla da tartışılmayı bekleyen bir konudur. Konunun uluslararsı alanda tartışılmaya başlanması da yakın bir geleceğe dayanmaktadır. Yakın zamana kadar uluslararası ve ulusal alandaki sivil toplum kuruluşu mensupları dünya nüfusunun yansını oluşturan bir grubumn insan haklan ihlallerini görmezden gelmekteydi. Bu görmemezlik yavaş değişmekte ve de bir çok kesime ulaşmamıştır. Kadınlara karşı bu şiddet özel alanda gerçekleştiğinden ve de aile bireyleri tarafından birbirine uygulandığından önemsiz olarak alınmaktadır. Dolayısıyla gereken yapılmamaktadır. Bu tez bütün bu konulan ve Birleşmiş Millet'lerin tutumunu tartışmaktadır. Buna ek olarak uluslararası hukuğun ilgili bölümleri feminist bakış açısından incelenip yeni öneriler getirilmiştir. Bu tezin amacı teorik olmaktan çok pratiğe yönelik olup Appendix bölümünde ilgili öneriler verilmektedir. Kamu/özel alanın hukuksal ve de felsefi incelemesi sonucunda kadına ait insan haklarının henüz emekleme döneminde olduğu sonucuna varılmıştır. Bu durumdan kurtulunabilinmesi için toplumun her kesiminden olan insanların katılımı gerekmektedir.

ABSTRACT Of all the ways that one group systematically violated and mistreated another, none is more deeply rooted and older than the way men treated women. All other discriminations pale by contrast, and relatively recent, requiring racial, ethnic, and religious creation. Gender is as old as human existence. Therefore, at the end of this millennium my study addresses this oldest and deepest complex issue of the humanities. Women's human rights violations still await to be defined and discussed, and finally to be resolved in the current human rights instruments. The international community with its current perspective is ill prepared to discuss and solve these grave problems which affect at least half of the world's population. The United Nations pertains to address violations of human rights throughout the world since 1948. After introducing the Universal Declaration of Human Rights, the first international instrument on the subject and a milestone for humankind in our age, the UN have been trying to address the issue since then in many avenues. However, not unlike other mechanisms in the UN Human Rights Commission does not have a regulatory power over the states and it fails to address the violations in the private sphere. Even after solving these problems, the issues relating to women are far complex and diverse to be solved by the international community alone. This thesis not only analyses the generation of human rights and current instruments, but also suggests new ways of integrating gender into human rights mechanisms in the United Nations in order to solve the problems. Moreover, public policy suggestions have been introduced in reforming the effectiveness of police force in dealing with the domestic violence cases. In addition, the current international human rights law is studied and analysed in its relevance to the women's human rights violations. Feminist methodology, and current political thought including international relations were examined from a different perspective.11 Women's NGOs have been very influential in introducing CEDAW and empowering the women in the international community. The ultimate objective this thesis is not only a theoretical one. but it hopes to contribute to practical changes.
