Özet
Yükseköğretim kurumları personelinin kamusal hizmetleri ifa etmeleri sonucu görev dolayısıyla veya görev sırasında adli suç teşkil eden fiilleri 2547 sayılı Yükseköğretim Kanunu'nun m. 53/c hükmüne istinaden özel bir soruşturma sistemine tabidir. Yükseköğretim kurumları personelinin soruşturma işlemlerinde 4483 sayılı Memurlar ve Diğer Kamu Görevlilerinin Yargılanması Hakkında Kanun ile 5271 sayılı Ceza Muhakemesi Kanunu'nun temel ilke ve kuralları da 2547 sayılı Yükseköğretim Kanunu'nun m. 53/c-(8) atıf hükmüne istinaden geçerlidir. Yükseköğretim kurumlarında soruşturma işlemlerini başlatma hak ve yetkisine sahip olan amirler, Cumhuriyet savcılarının yetkisine sahip olan soruşturmacılar ile soruşturma işlemlerinin idari anlamda kesin karar merci olan yetkili kurulların yapısının, işleyişinin, görevlerinin ve yükümlülüklerinin doktrin ve yargı içtihatları kapsamında bilinmesi, yorumlanması ve değerlendirilmesi adil yargılanma ilkesine uygun bir soruşturma evresinin yürütülüp sonuçlandırılması açısından zorunludur.

Acts constituting a judicial crime as a result of the performance of public services by the personel of higher education institutions, as a result of their dut yor during their duty, are subject to the Article of the Higher Education Law no 2547. It is subject to a special investigation system pursuant to the 537c provision. In the investigation process of the personnel of higher education institutions, the basic principles and rules of the Law no 4483 on the Trial of Civil Servants and Other Public Officials and the Criminal Procedure Law no 5271 are also included in Art. 2547 of the Higher Education Law. 53/c-(8) is valid based on the reference provision. It is in accordance with the principle of fair trial that the structure, functioning, duties and obligations of the supervisors who have the right and authority to initiate investigation proceedings in higher education institutions, investigators who have the authority of public prosecutors and the authorized boards, which are the final decision making body in the administrative sense within the scope of doctrine ande judicial case-law are in line with the principle of fair trial. It is mandatory in terms of conducting and concluding an investigation phase.
