Özet
Bu tez çalışmasının konusunu“Covid-19 Salgın Hastalığı Sebebiyle Özel Eğitim Kurumlarında Ücret İadesi Meselesi”oluşturmaktadır. Konu halen güncel bir sorun olup, bu soruna hukuki yönden çözüm getirebilecek kurumlar üzerinde durulacak ve konu farklı yönleriyle yine bu kurumlar bazında incelenecektir. Covid-19 olarak bilinen solunum yolu bulaşıcı hastalığı Dünya Sağlık Örgütü'nün raporuna göre yüzden çok ülkede görülmüş ve uluslararası kamu sağlığı acil durumu ilan edilmiştir. Ülkemizde de Sağlık Bakanlığı bünyesinde oluşturulan Koronavirüs Bilim Kurulunun önerileri doğrultusunda hastalığın yayılma hızını en aza indirmek amacıyla vatandaşlarımızın yakın mesafede bir arada bulunduğu tiyatro, sinema, düğün salonu vb. yerlerin faaliyetleri geçici süreliğine durdurulmuş, resmi ve özel eğitim kurumlarında da uzaktan eğitime geçilmiştir. Çalışmamızda inceleyeceğimiz özel eğitim kurumları kapsamına; okul öncesi, ilkokul ve ortaokul öğrencilerine yönelik hizmet sunan kolejler, kreşler ve diğer özel nitelikteki eğitim kurumları girmektedir. Yükseköğretim düzeyindeki öğrencilere hizmet sunan vakıf üniversiteleri ise çalışma konumuzun kapsamına dâhil edilmemiştir. Eğitim ücretinin tamamı ödenmemişse 6098 Sy. TBK md. 138 gereği aşırı ifa güçlüğü hükümleri doğrultusunda uyarlama davası yoluyla ücretten indirim talep edilebilecektir. Eğer ücret peşin ödenmişse yatakhane, kütüphane, etüt, konferans salonları, servis, yemekhane gibi eğitim hizmetinin fiziki ve yüz yüzelik gerektiren yan edimi niteliğindeki bilimsel, kültürel, sportif ve sosyal imkânlardan faydalanmaya ilişkin edimler 6098 Sy. TBK'nin 136. ve 137. maddelerinde düzenlenen imkânsızlık kurumu çerçevesinde geri istenilebilecektir. Temel hizmet edimi niteliğindeki eğitim hizmetinin karşılığı, eğitim ücreti ise toplumun geniş kesimince olumsuz görüş bildirilen ve uzaktan eğitimin örgün eğitimin ikamesi olarak kabul edilmediği, tüketicinin umduğu makul faydayı sağlayamadığı gözetilerek, telafi eğitimi yapılmadığı müddetçe 6502 Sy. TKHK'nin 13. maddesi uyarınca ayıplı hizmet hükümleri çerçevesinde bedelden indirim istenilebilmesi hukuken mümkündür. Konunun 6098 Sy. TBK'nin 30 vd. maddelerinde düzenlenen yanılma hükümleri bakımından değerlendirilmesinde hukuki bir sonuca ulaşılamayacaktır.

The subject of this thesis is“The Issue of Refunds in Private Education Institutions due to the Covid 19 Epidemic”. The subject is still a current problem, and the institutions that can bring a legal solution to this problem will be emphasized and different aspects will be examined on the basis of these institutions. According to the report of the World Health Organization, the respiratory infectious disease known as Covid-19 has been seen in more than a hundred countries and has been declared an international public health emergency. In our country, in line with the recommendations of the Coronavirus Scientific Committee established within the Ministry of Health, in order to minimize the spread of the disease, theater, cinema, wedding hall, etc., where our citizens are together at a close distance. The activities of the places have been temporarily suspended, and distance education has been started in public and private education institutions. Within the scope of private education institutions that we will examine in our study; foundation universities, colleges, kindergartens and other private educational institutions providing services for pre-school, primary, secondary, high school and university students. As per the provisions of 138, a reduction in wages can be requested through adaptation lawsuits in line with the provisions of excessive difficulty in performance. If the fee is paid in advance, the actions related to benefiting from scientific, cultural, sportive and social opportunities that require physical and face -to-face performance of the education service such as dormitory, library, study, conference halls, service, cafeteria. It can be requested back within the framework of the impossibility institution regulated in Articles 136 and 137 of the TCO. The education fee in return for the education service, which is a basic service act, is determined by the 13th article of the TKHK, number 6502, unless the compensatory education is provided, considering that the negative opinion of the large part of the society is expressed, and distance education is not accepted as a substitute for formal education and does not provide the reasonable benefit expected by the consumer.
