Özet
6331 sayılı İş Sağlığı ve Güvenliği Kanunu göz önünde tutularak işçi sıfatıyla çalışanların üzerinde bulunan yükümlülükleri ihlal ederek iş sağlığını ve güvenliğini tehlikeye düşürmesi halinde doğabilecek sonuçlar incelenecektir. Bu kapsamda iş sağlığı ve güvenliği kavramlarından bahsedilmiş olup kaynaklarına yer verilmiştir. İşçi ve işverenin yükümlülüklerine değinilmiştir. İşçinin yükümlülüklerini ihlal ederek iş güvenliğini tehlikeye düşürmesi durumunda işveren tarafından iş sözleşmesinin haklı nedenle fesih edilip edilemeyeceği ve doğabilecek tazminat sorumluluğu Yargıtay kararları kapsamında ele alınarak incelenmeye çalışılacaktır. İşveren tarafından çalışanın iş güvenliği sorumluluklarına karşı yaptığı aykırı davranışlar neticesinde işçisine yönelik haklı neden ile fesih hakkına yer verilmiş olup fesih hakkının ileri sürülebileceği haller birçok açıdan incelenmiştir. İşçinin yol açtığı zararlar nedeniyle sorumluluğu ve tazmininin belirlenmesinde dikkat edilecek hususlara yer verilmiştir. Çalışmamızda konuyla ilgili olarak yazılı ve bilimsel eserler, makaleler, doktrinel çalışmalar ile yargının konuyla ilgili vermiş olduğu kararları değerlendirilmiştir.

Taking into account the Occupational Health and Safety Law No. 6331, the consequences that may arise if employees violate their obligations as workers and endanger occupational health and safety will be examined. In this context, the concepts of occupational health and safety are mentioned and their sources are included. The obligations of the employee and employer are mentioned. In case the employee violates his obligations and jeopardizes his job security, the employer will try to examine whether the employment contract can be terminated for just cause and the liability for compensation that may arise, within the scope of the Supreme Court decisions. The situations in which the right of termination with a just cause can be asserted against the employee as a result of the violation of the employee's occupational safety responsibilities by the employer has been examined in many respects. The issues to be considered in determining the liability and compensation for the damages caused by the worker are included. Written and scientific works, articles, doctrinal studies and judicial decisions related to the subject were evaluated.
