Özet
This study deals with introducing al-Shafiî and Abu Zaid al-Dabbûsî and their approach to jurisprudence and its fundamentals. The study was based on scientific research and studies that al-Shafiî and al-Dabbûsî recorded, then on the books of the companions of al-Shafiî and the companions of the Hanafi school. The study focused on introducing the scholarly works written by them and extracted from them the following chapters: In the introductory chapter of this study, the researcher attempted to draw a comprehensive view in introducing al-Shafiî and al-Dabûsî through their works, and to prove the impact of their approach on the Islamic scholars who based their methodology on the doctrines of theologians and jurists. And the fact that al-Shafiî was the founder of the sect and had the first recorded book in the methodology of Islamic law, asking him to be placed in a unique position in this science. Also, al-Dabûsî, played an important role in the formation of the Hanafi school in Transoxiana that began to be formed with al-Jassâs compilations. In the first chapter of this study, the researcher dealt with issues such as al-bayan (elucidation), al-naskh (abrogation), al-khabar (tradition) and al-qiyas (analogy) with them, then determined and detailed the views of al-Shafiî and al-Dabûsî on these issues firstly from their compilations and then from books approved in their doctrines. In this regard, al-bayan was explained with its definition, types, and manner, and abrogation with its definition and al-naskh by mentioning differences in the versions of the Sunnah and the Qur'an each other, and al-khabar with authoritative hadiths for one and the transmitters' traditions, and al-qiyas with his authenticity, its pillars, conditions, and application to them. In this regard, the opinion of al-Shafiî on the topic, then the views of al-Dabûsî on the same topic were explained and studied. Finally, al-Dabûsî's criticisms of al-Shafiî were mentioned in them. Presented and discussed. In the second chapter of this study, the researcher completed an attempt to uncover the effect of al-Dabûsî's objections on al-Shafiî and their effect on the Mutekallimun jurists in two ways. In line with this purpose, the first requirement attempted to define details of the objections of al-Shîrazî, al-Sam'anî and al-Ghazalî to al-Dabûsî regarding these four issues were mentioned, and he tried to define their views on this issue. In the second request, explains the influence of al-Dabûsî on the fundamentalists such as alShîrazî, al-Juwaynî, al-Sam'anî and al-Ghazalî in matters of al-bayan, al-naskh, alkhabar and al-qiyas. An attempt has been made to present the influence of al-Dabûsî in al-Mutakallim's curriculum with details of the opinions of these scholars who adopted it by leaving al-Shafiî. As a result of this study, it was found that al-Shafiî played an unparalleled role in the Islamic Law, and there were scientific criticisms leveled against him by al-Dabûsî from the Hanafi school. And since these criticisms directed at al-Dabûsî led to a review of alShafiî 's views and commented on them within some works such as Qavati'u al-Edille fi al-Usûl and Shifâu al-Ghalîl.
