Özet

Bu çalışmanın amacı nakliye poliçelerinde sigortacıların halefiyet hakkı boyutunun ulusal ve uluslararası doktrin ve konuyla ilgili yerel ve yüksek yargı organları kararları ışığında incelemektir. Sigortacının halefiyet hakkı, sigorta şirketinin ödediği tazminat miktarını geri almak veya hasarın gerçekleştiği mala ilişkin hakları kullanmak için sigortalı adına hareket etme yetkisini sağlamaktadır. Nakliye poliçelerinde, hasar durumunda sigorta şirketi genellikle sigortalıya tazminat ödemekte ve bu tazminatla birlikte sigortalı adına maldan veya taşıma sözleşmesinden doğan hak ve alacaklara sahip olmaktadır. Sigorta şirketi, sigortalı adına hareket ederek, tazminat ödenen miktarı geri almak veya sigortalının sahip olduğu hakları kullanmak için gerekli yasal adımları atabilmektedir. Örneğin, sigortacı, hasarın gerçekleştiği mala ilişkin sigortalının tazminat taleplerini yerine getirebilir veya sigortalının haklarını takip edebilmektedir. Sigorta şirketinin halefiyet hakkı, sigorta sözleşmesi ve ilgili yasalara dayanarak tanınan bir hak olup, poliçe şartlarına ve yerel yasalara bağlı olarak değişebilmektedir. Bu hak, sigorta şirketinin poliçe kapsamında gerçekleşen bir hasar durumunda, sigortalının menfaatlerini korumak ve sigortacının tazminat ödediği miktarı geri almak için kullanılmaktadır. Çalışma sonucunda nakliye sigortalarında nedensellik ilişkisinin tespit edilmesi konusunda güçlükler olduğu ve bu konuyla ilgili daha açık düzenlemelerin yapılması ve işbirliği sağlanması gerekmekte olduğu değerlendirilmektedir.

For this purpose, it preserves the decisions of local and higher judicial bodies regarding the national and international legal literature and control of the subrogation rights of the insurers in the transport police. The insurer's right of subrogation provides the insurer with the power to act on behalf of the insured to recover the amount paid by the insurer or to exercise the rights to the property for the use of damages. In transport polices, in case of damage, the insurance company usually pays compensation to the insured and, together with this compensation, has the rights and receivables arising from the goods or the contract of carriage on behalf of the insured. The insurance company, acting on behalf of the insured, may take legal action to recover the indemnity amount or to exercise the rights of the insured. For example, the insurer may fulfill the compensation of the insured for the property covered by the bodies or they may follow the speed of the insured. Insurance company subrogation is a right that is exercised based on the insurance contract and related merits and may vary depending on police provisions and local laws. This right is used to protect the interests of the insured and to recover the amount paid by the insurer in the event of a damage under the insurance company's police. It is known that there are difficulties in determining the causality relationship in transport insurances and clearer regulations and cooperation are needed.
