Özet
Futbol kulüpleri, amaçlarına ulaşmak için profesyonel futbolcular ile bir futbol takımı kurarak müsabakalarda mücadele etmektedir. Profesyonel futbolcu sözleşmesi olarak adlandırılan sözleşmeler ise profesyonel futbolcu ile profesyonel futbol kulübü arasındaki hakları ve yükümlülükleri düzenlemektedir. Bu araştırmamızda profesyonel futbolcu sözleşmelerinin unsurları, özellik arz eden durumları, kendiliğinden veya tarafların iradesi ile oluşacak sona erme halleri ve her ihtimal değerlendirilerek sona ermenin sonuçları araştırılarak analiz edilmiş, sorunlar ve eksikler tespit edilmiş ve önerilerde bulunulmuştur. Profesyonel futbolcular ile profesyonel futbol kulüpleri arasında akdedilen profesyonel futbolcu sözleşmelerinin niteliğinin genel hizmet sözleşmesi olduğunun tespiti yapılmış, bu bağlamda değerlendirmeler ve araştırmalar gerçekleştirilmiş. Profesyonel futbolcunun ilk defa profesyonel olması, eski sözleşmesinin tamamlanmasından sonra yeni bir takımla veya bonservis bedelinin ödenmesi karşılığında farklı bir futbol kulübü ile sözleşme imzalaması veya ilk defa profesyonel olma durumlarında imzalandığının tespiti yapılmıştır. Futbolcunun işçi ve her zaman gerçek kişi, futbol kulübünün ise her zaman tüzel kişi ve işveren olduğu iki taraflı sözleşmeler olduğu, futbolcunun asıl borcunun iş görme, futbol kulübünün ise ücret ödeme borcu olduğu sözleşmeler olması tespitinden sonra araştırmalar bu yönde ilerlemiştir. Türk futbolunu ulusal düzeyde yürüten ve düzenleyen tek kuruluş Türkiye Futbol Federasyonu'dur. Statü, talimat ve kararlar çıkartmaya yetkilidir. Araştırmamızda faydalanılan Profesyonel Futbolcuların Statüsü ve Transferleri Talimatı ise profesyonel futbolcu sözleşmelerine ilişkin düzenlemeler içerir. Araştırmamız genel anlamda iç hukuk sınırları içerisinde değerlendirilmiştir. Bu hususta düzenlenen normlar, kararlar ve doktrin kapsamında araştırmalar yürütülmüştür. Araştırmaların nihayetinde sözleşmenin taraflarının ortak iradesi haricinde sözleşmelerin süresinin tamamlanması ile sonlanması mümkün olduğu sonucuna ulaşılmıştır. Bunun haricinde bir tarafın fesih hakkını kullanması söz konusu olduğu, fesih durumunda haklı feshe neden olan ya da haksız fesih yapan tarafın zararı giderme yükümlülüğü olduğu sonucuna varılmıştır. Talimatlar ışığında ise bazı yükümlülüklere ilişkin olarak da sportif cezaların uygulanma halleri araştırılmıştır.

Football clubs aim to achieve their goals by forming a football team with professional players and competing in matches. The contracts known as professional football player contracts regulate the rights and obligations between the professional football player and the professional football club. In this research, the elements of professional football player contracts, their special situations, the termination situations that may occur spontaneously or by the will of the parties and the consequences of the termination by evaluating every possibility have been investigated and analysed, problems and deficiencies have been identified and suggestions have been made. Nature of the professional football player contracts concluded between professional football players and professional football clubs is determined to be a general service contract, and evaluations and researches have been carried out in this context. It has been determined that these contracts are signed in cases where the professional footballer becomes a professional for the first time, signs a contract with a new team after the completion of his old contract, or signs a contract with a different football club in return for the payment of a fee called the fee called the fee. Following the determination that these are bilateral contracts in which the footballer is an employee and always a real person and the football club is always a legal person and always an employer, and that the main obligation of the footballer is to perform work and the football club is obliged to pay wages, researches have progressed in this direction. The only organization that conducts and regulates Turkish football at a national level is the Turkish Football Federation. It has the authority to issue statutes, regulations, and decisions. The Instruction on the Status and Transfers of Professional Footballers, which was utilized in our research, contains regulations on professional footballer contracts. Our research has been evaluated within the limits of domestic law in general terms. Research has been conducted within the scope of the norms, decisions and doctrine regulated in this regard. At the end of the researches, it has been concluded that it is possible to terminate the contracts with the completion of the term, except for the common will of the parties to the contract. Apart from this, it has been concluded that one party may exercise the right of termination, and in case of termination, the party that causes justified termination or wrongful termination is obliged to compensate the damage. In the light of the instructions, the application of sportive penalties in relation to some obligations has been investigated.
