Özet
Türkiye'de tohum, zengin biyolojik çeşitlilik ve geniş ve verimli topraklarda yapılan tarım faaliyeti nedeniyle büyük bir öneme sahiptir. Bu tez, Türkiye'de tohumculuk sektörünü kurumsal ve yasal açıdan detaylı bir şekilde analiz ederek, sektörün genel yapısını incelemektedir. Yasal yapı çerçevesinde, tohumculuk çalışmalarının tarihçesi, kavramsal çerçeve, ulusal ve uluslararası mevzuat açıklanmaktadır. İlk bölümde, ulusal düzenlemelerde, tohum sertifikasyonu, ıslahçı hakları ve yeni bitki çeşitleri, yerel tohumların kayıt altına alınması ve muhafazası ile biyogüvenlik çerçevesinde genetiği değiştirilmiş tohumların kontrolü ile ilgili düzenlemeler incelenmektedir. Ayrıca, tohumculuk alanındaki kurumsal yapı detaylı bir şekilde ortaya konulmuş; Tarım İşletmeleri Genel Müdürlüğü (TİGEM), Türkiye Tohumcular Birliği (TÜRKTOB) gibi birimler, Tarım ve Orman Bakanlığı ve çatısı altındaki Bitkisel Üretim Genel Müdürlüğü (BÜGEM) ve Tarımsal Araştırmalar ve Politikalar Genel Müdürlüğü (TAGEM) açıklanmış ve eksikliklerinin giderilmesi için öneriler getirilmektedir. Bu çerçevede, sektörde faaliyet gösteren kurum ve kuruluşların rolleri ve etkileşimleri değerlendirilmiştir. Özellikle, Tarım ve Orman Bakanlığının görevli olduğu faaliyetlerde yetki devrinin mümkün olup olmayacağı özel hukuk tüzel kişilerinin kamu hizmeti niteliğindeki tohumculuk işlemlerini gerçekleştirip gerçekleştiremeyeceği Anayasa Mahkemesi kararı çerçevesinde tartışılmıştır.

In Turkey, the seed industry holds a prominent position, attributed to the nation's rich biological diversity and the fertile soils that offer substantial potential. This thesis presents an in-depth analysis of Turkey's seed industry, delving into its comprehensive framework encompassing institutional and legal dimensions. It thoroughly examines the sector's structure, tracing its evolution through historical and legal lenses, and elucidates the influence of international regulations on Turkey's seed-related policies. In the first section, an in-depth examination is conducted on regulations related to seed certification, breeder's rights, the recording and conservation of indigenous seeds, and the oversight of genetically modified seeds within the context of biosafety. Additionally, the corporate structure in the field of seed production has been detailed; units such as the General Directorate of Agricultural Enterprises (TİGEM), Turkey Seed Growers Association (TÜRKTOB), and the General Directorate of Plant Production (BÜGEM) and the General Directorate of Agricultural Research and Policies (TAGEM) under the Ministry of Agriculture and Forestry have been explained, and recommendations have been provided to address any deficiencies. In this context, the roles and interactions of institutions and organizations operating in the sector have been evaluated. Particularly, the possibility of delegation of authority in activities under the responsibility of the Ministry of Agriculture and Forestry and whether private legal entities can carry out seed-related processes of public service nature have been discussed within the framework of the Constitutional Court decision.
