Özet
ÖZET İnsan haklarının geçmişi ikibinli yıllara kadar uzanırken Çevre Hakkının literatüre geçmesi 20-30 yıllık bir geçmişe sahiptir. Çevre sorunlanmn(sanayi kirliliği, hava kirliliği, asit yağmurları, ozon tabakasının incelenmesi, sera etkisi, nükleer atıklar) dünya ölçeğinde insan yaşamının devamım tehdit eder bir noktaya varmasıyla, çevrenin Hukuk aracılığıyla korunması fikrinin ortaya çıktığı görülmektedir. Çevre, tüm yaşam küresinde birey ya da grubun doğrudan fiziki ortamda uzanan öğelerini kapsamına alır. Çevre Hakkının özneleri her insan ve toplu olarak herkestir. Konusu ise insan varlığı ile yeryüzünün canlı organizmalanmn yaşamlarım sürdürdüğü bölümdür. Hakkın muhatabı ise klasik haklardan farklı olarak hem devlet hem de bireylerdir. Çevre sorunlarının yaşama olan tehdidi sınırlı bir biçimde de olsa ülkemizde de 1980'li yıllarda kamuoyunu harekete geçirirken aynı tarihlerde hukuksallaşma sürecinin de başladığı görülmektedir. 1982 Anayasasının 56. Maddesinde“herkes sağlıklı ve dengeli bir çevrede yaşama hakkına sahiptir çevreyi geliştirmek, çevre sağlığım korumak ve çevre kirlenmesini önlemek devletin ve vatandaşın ödevidir.”Hükmü yer alırken bu ilkeye dayanarak çevre ile ilgili bir çok yasal düzenlemeler yapılmıştır. Bu hukuksal düzenlemeler doğrultusunda Anayasa Mahkemesi, Danıştay ve Yargıtay'ın Çevre Hakkım tanıyan bir çok kararlan mevcuttur: i

Summary While the history of human rights stretches back almost two thousand years, writings m Environmental Rights in fact began only in the last 20-30 years. Viewing the issue in ts global dimensions, we are seeing that, due to the emergence of environmental problems hat threaten the continuance of human life (industrial waste, air pollution, acid rain, lepletion of the ozone layer, greenhouse effect and nuclear waste), the concept has leveloped of preserving the environment by means of legislation. The 'environment' includes all life on Earth, whether individual or collective, and ;xtends to aspects of its physical circumstances. The area of Environmental Rights covers ;very individual and, as a community, everyone. As a scientific discipline, it is concerned with human existence and the living organisms on the surface of this planet. On the question of rights, it differs from the normal meaning in being related both to the government and the individual. It can be said that the threat of environmental problems towards life, even in a limited Form, started in the 1980s and in the same years action began to be taken by the public sector. In provision 56 of the 1982 Constitution (To possess the right to live in healthy and balanced surroundings, to improve the environment, to protect Environmental Health and to prevent the pollution of the environment is the obligation of the government and svery citizen.'), several regulations were instituted based on this principle, which were incorporated on the statue book. These legal measures recognising Environmental Rights are present in several decisions made by the Constitutional Court, Council of State and Supreme Court.
