Özet

Federal vergi yasası, kar amacı gütmeyen hastanelere toplumsal fayda sağlamaları karşılığında vergi muafiyeti tanımaktadır. Vergi muafiyetinin gerekçelerinden biri, yıllar içinde gelişen toplumsal fayda standardıdır. Kar amacı gütmeyen hastaneler için geçerli olan mevcut toplumsal fayda standardı, bu hastanelerin halkın veya topluluğun sağlığını iyileştirmelerini, dolayısıyla hayırsever olmalarını beklemektedir. Toplumsal fayda standardıyla ilgili önemli bir sorun, kar amacı gütmeyen hastanelere yönelik vergi muafiyetine ilişkin hukuki gerekçe ile federal rekabet hukuku yaklaşımı arasındaki tutarsızlıktır. Günümüzde, kar amacı gütmeyen hastaneler, rekabet hukuku davalarında nadiren özel muamele görmekte, bu da bu tür hastanelerin pazar gücünü artırabilmektedir. Bu tezde, kar amacı gütmeyen hastanelerin toplumsal fayda sağlama ve pazar gücü konularını inceleyerek hem mevcut tutarsızlığı hem de toplumsal fayda standardının gerekçesini değerlendirmeyi amaçlıyorum. Bu amaca ışık tutmak için tezde iki hipotez test ediyorum. İlk hipotezde, ilk iki bölümde kar amacı gütmeyen hastanelerin daha fazla pazar gücü kazandıklarında daha fazla toplumsal fayda sağlayıp sağlamadıklarını inceliyorum. İkinci hipotezde ise, üçüncü ve son bölümde, kar amacı gütmeyen hastanelerin daha fazla pazar gücü ile halkın veya topluluğun sağlığını iyileştirip iyileştirmediğini araştırıyorum. Birinci bölümde, 2010-2016 yıllarına ait IRS Form 990 Schedule H, Amerikan Hastane Birliği Yıllık Anketi ve Sağlık Maliyeti Raporlama Bilgi Sistemi (HCRIS) verilerini kullanarak, kar amacı gütmeyen hastanelerin daha fazla (veya daha az) pazar gücüne sahip olduklarında toplumsal fayda düzeylerini artırıp artırmadıklarını ulusal düzeyde inceliyorum. Sonuçlar, toplam pazar sabit etkileri kontrol edildiğinde hastane yoğunluğundaki artışların toplumsal fayda düzeylerini artırdığını göstermektedir. Ancak hastane sabit etkileri kontrol edildiğinde, hastane yoğunluğu ile toplumsal fayda sağlama arasındaki ilişki negatif hale gelmektedir. Bu durum, hastane bazlı ve pazar düzeyindeki özelliklerin, hastanelerin pazar gücünden daha iyi açıklayıcı olabileceğini göstermektedir. İkinci bölümde, analize Decision Resource Groups (DRG) veri setini ekleyerek sigortacı pazar yoğunluğunu dahil ediyorum. Sağlık Maliyeti ve Kullanımı Projesi (HCUP) Eyalet Hasta Veritabanı (SID) kullanarak hasta seçim modelini tahmin ediyor ve geleneksel rekabet ölçümündeki içsellik sorunlarını ele almak için hastane rekabetini hesaplıyorum. Ancak, bu hipotezi sadece 2012-2016 yılları arasında Florida, New York, Vermont, Massachusetts, Arizona ve Utah eyaletleri için inceleyebiliyorum. Sonuçlar, sigorta rekabeti dikkate alındığında, kar amacı gütmeyen hastanelerin daha fazla pazar gücüyle toplumsal fayda sağlama düzeylerinin arttığını göstermektedir; ancak hastane ve sigortacı rekabetinin toplumsal fayda sağlama üzerinde istatistiksel olarak anlamlı bir etkisi bulunmamaktadır. Üçüncü ve son bölümde, IRS ve hastanelerin toplumsal fayda faaliyetlerinin topluluğun sağlığını iyileştirip iyileştirmediğini gözlemlemediğini savunuyorum. Bu sorunu, hastane pazar gücünün sigortasız hastaların önleme kalitesi göstergeleri üzerindeki etkisini inceleyerek ele alıyorum. Bu göstergeleri topluluk sağlığının bir ölçütü olarak kullanıyorum. 2012-2016 yılları arasında altı eyalet için IRS Form 990, HCRIS ve HCUP Eyalet Hasta Veritabanı verilerini kullanıyorum. Sonuçlar, daha yoğun hastane pazarlarında kar amacı gütmeyen hastanelerin topluluklarını toplumsal fayda sağlama yoluyla iyileştirdiğine dair anlamlı bir kanıt sunmamaktadır. Bunun aksine, sigortacı pazarlarında önleme kalitesi göstergelerinin iyileştiğine dair destekleyici kanıtlar bulunmaktadır.

Federal tax law provides tax exemptions for nonprofit hospitals in exchange for community benefit provisions. One justification for tax-exempt status is the community benefit standard, which has evolved over the years. The current community benefit standard for nonprofit hospitals, which gives them tax exemption, expects nonprofit hospitals to promote the health of the public or community to be charitable. A significant problem with the community benefit standard is the inconsistency between the legal rationale of tax exemption for nonprofit hospitals and the federal antitrust laws' approach to nonprofit hospitals. Currently, nonprofit hospitals rarely receive special treatment in antitrust law cases, which might increase the market power of nonprofit hospitals. I argue in this dissertation that by studying nonprofit hospitals' community benefit provisions and their market power, it is possible to evaluate both the current inconsistency and the rationale of the community benefit standard. To shed light on this, I test two hypotheses in this dissertation. As a first hypothesis, I study whether nonprofit hospitals provide more community benefits once they gain more market power in the first two chapters. Second, I study whether nonprofit hospitals promote the health of the public or their community with more market power in the third and final chapter. In the first chapter, I investigate whether nonprofit hospitals increase (decrease) community benefits with more (less) market power using the 2010–2016 IRS Form 990 Schedule H, American Hospital Association Annual Survey, and Healthcare Cost Report Information (HCRIS) database at the national level. The results show that higher levels of hospital concentration lead to a higher provision of community benefits when total market fixed effects are controlled for. When hospital fixed effects are controlled, the association between hospital concentration and community benefit provision becomes negative. This suggests that hospital-specific and market-level characteristics might explain the provision of community benefits better than hospitals' market power. In the second chapter, I add insurer market concentration to the analysis by including the Decision Resource Groups (DRG) dataset. Using the Healthcare Cost and Utilization Project (HCUP) State Inpatient Databases (SID), I also estimate the hospital choice model of patients to calculate hospital competition and address endogeneity issues of traditional competition measures. As a trade-off, I investigate the same hypothesis for only the following states from 2012 to 2016: Florida, New York, Vermont, Massachusetts, Arizona, and Utah. The results show that, considering insurer competition, nonprofit hospitals do have increased community benefit provisions with more market power; however, there is no statistically significant evidence of the effect of hospital and insurer competition on the community benefit provision of nonprofit hospitals. In the third and final chapter, I argue that the IRS and hospitals do not observe whether community benefit activities actually promote the community's health. I investigate this issue by examining how hospital market power affects the prevention quality indicators of uninsured patients as an indication of community health. I use data from IRS Form 990, HCRIS, and the HCUP State Inpatient Database for six states from 2012 to 2016. The results show no significant evidence that nonprofit hospitals improve their communities through community benefit provisions in more concentrated markets. Unlike hospital competition, there is supporting evidence that prevention quality indicators improve in more concentrated insurer markets.
