Özet
Medeni Usul Hukuku Bakımından Takas isimli bu çalışma, İstanbul Üniversitesi Sosyal Bilimler Enstitüsü Özel Hukuk Anabilim Dalında yüksek lisans tezi için hazırlanmıştır. Çalışma, takasın; Medeni Usul Hukuku'ndaki bazı kurumlar arasındaki ilişkisine, savunma niteliğine ve buna bağlı sonuçlarına, yargılama içinde ilk defa terditli veya terditsiz olarak savunma yoluyla yahut terditli veya terditsiz karşı dava açarak başvurulmasına bağlı hukuki niteliğine ve buna bağlı olarak doğacak sonuçlara odaklanmakla beraber, odaklandığı yere dair akla uygun gerekçeli sonuçlara varmak ve takas kurumunu tanımak adına zorunluluk teşkil eden takasın anlamına, işlevine, hukuki niteliğine, benzer kurumlar ile farklarına, türlerine, şartlarına, kullanımına ve kullanımına bağlı sonuçlarına dair bilgi ve değerlendirmeler içermektedir. Çalışmanın içeriğindeki bilgi ve değerlendirmelere; iki takas monografisi, takas ile ilişki kurulan Medeni Usul Hukuku kurumları monografileri, Medeni Usul Hukuku hakkında genel kitaplar ile şerhler, Borçlar Hukuku genel hükümleri hakkında kitaplar, takasa ve takas ile ilişkilendirilen Medeni Usul Hukuku kurumlarına dair makaleler ile yargı kararları ve çalışmanın konusu bakımından ikincil önem arz eden basılı ve süreli eserler kaynaklık etmektedir.

This study, titled Barter in terms of Civil Procedure Law, was prepared for the master's thesis in the Private Law Department of the Social Sciences Institute of Istanbul University. The study focuses on the relationship between barter and some institutions in the Civil Procedure Law, the nature of the barter as defense and the consequences related to it and the legal nature and consequences of applying barter as the defense in the first time by stages or not by stages in an action or a by stages counter action. İn order to get reasoned and justified conclusions about the focusing issue and to comprehend the barter, the study contains information and evaluations on barter of meaning, function, legal nature, differences with similar institutions, types, conditions, exercise and results. The information and evaluations in the content of the study are sourced from two barter monographs, monographs on the institutions of Civil Procedure Law that are related to barter in the study, general books and commentaries that include the provisions of Civil Procedure Law, books on general provisions of the Law of Obligations, articles on barter and the institutions of Civil Procedure Law that are related to barter in this study, court decisions and printed and periodical works that are of secondary importance in terms of the subject of the study.
