Özet

This thesis is the fruit of a lot of wandering, in a conceptual as well as practical studies and intellectual sense. The study in this thesis started at the University of Sarajevo where, in the beginning, I was an exchange student, and I would like to research how the relations between statehood, minority rights, institutions, and competencies are played out in the everyday life of the national Bosniak minorities living in Serbia. The previous theoretical studies that I have read and studied with ever since have been the guides of my fieldwork. The final version of the thesis was submitted to South-Eastern European Studies at the University of Belgrade. In the course of time, many different people provided support for the thesis in many different ways. There is no chance to be able to thank them all. I am greatly grateful to people from Sandžak for sharing their information and experience and letting me learn from them. Being in the first place, I would like to thank Jens Woelk for his intellectual guidance and support in the writing process. Özet (Çeviri)

This thesis explores the Bosniak National Minority Council, one of the national minority councils, a practical implementation of Serbia's non-territorial autonomy practice. The thesis also analyzes the practical implementations of legal competencies arising from the Law on National Councils for Bosniak National Minority Council in the fields of education, culture, information, language, and finance. The thesis debates the practical implementation of the Bosniak national minority's legal achievements living in Serbia. The thesis is divided into two main parts: after the illustration and discussion of the theoretical framework in the first part (A. NTA, National Minority Councils in Serbia, and BNV), the second part analyses the legal arrangements in favor of Bosniaks and their effective implementation (B. Competencies of BNV and Their Practical Application). The thesis consists of four chapters. In the first chapter, namely the introduction, a general definition of non-territorial autonomy practice in Serbia, are defined, the research design and questions are discussed, and the thesis is outlined. In the second chapter, the legal framework and historical transformation of non-territorial autonomy practice in Serbia are discussed. Besides, the impact of international regulations is examined, such as the Copenhagen criteria, Framework Convention for the Protection of National Minorities, and Lund Recommendations on the practice of Serbian non-territorial autonomy. Lastly, in the second chapter, the political conditionality theory, the neo-institutionalism theory, and the first theoretical discussion of the NTA by Renner and Bauer are examined as all have been associated with the implementation of national minority councils in Serbia. In the third chapter of the thesis, the historical development of the Bosniak national minority council is discussed; in other words, the autonomy struggle of Bosniaks living in Sandžak. The third chapter, starting with the analysis of the Bosniak identity and the term of Sandžak, continues with Bosniak autonomy struggles; in the latter section, the process that results in the establishment of the Bosniak National Minority Council is analyzed. In the last chapter of the thesis, the Bosniak National Minority Council's legal competencies in the fields of education, culture, language, and finance are analysed, followed by the practical application of these competencies and the related challenges before a critical evaluation is provided.
