Özet
ÖZET Toplu iş mücadelesinin en önemli vasıtalarından birisi olan grevin Türk hukukunda hizmet akdine etkisi tezimizin konusunu teşkil etmektedir. Bilindiği üzere işçilerin ve onların temsilcisi olan sendikaların toplu pazarlık ve sözleşme düzeni içerisinde pazarlık güçlerini oluşturan en önemli silahları grev müessesesidir. Greve başvurma imkanı olmayan işçi ve sendikalarını pazarlık güçleri yok denecek ölçüde azalmış olur. Bu denli önemli bir güç olan grevin hem tarafları hem üçüncü kişileri ve hatta kamuyu etkilemesi kaçınılmaz olacaktır. Buna binaen grevin anlamı, hizmet akdi ile olan ilişkisi ve hizmet akdine etkilerinin taraflar açısından iyi bilinmesinde büyük yarar vardır, özellikle grevin sonuçlarına doğrudan katlanacak olan işçiler ve işçi kuruluşları (sendikalar) tarafından iyi bilinmesi zaruridir. Biz çalışmamızda Türk Hukukunda, grevin hizmet akdine etkisini incelemeye çalıştık. Yabancı hukuklardaki grevin hizmet akdine etkisi konumuz dışındadır. Çalışmamızda birinci bölümde grev hakkı ve tarihi süreci, grev kavramı, kanuni grev ve kanundışı grevin unsurları ele alınmıştır. İkinci bölümde Türk Hukukunda kanuni grevin hizmet akitlerine etkisi hüküm ve sonuçları incelenmiştir. Üçüncü ve son bölümde ise Türk Hukukunda kanundışı grevin hizmet akitlerine etkisi hüküm ve sonuçları incelenmiştir.

SUMMARY The effect of the strike one of the major means of the collective labor movement, on the contract of service in Turkish law constitutes the subject of our dissertation. The strike as an institution is one of the most important weapons of the workers and their representatives, unions; forming their bargaining power within the context of collective bargaining and contract system. The workers and unions with no power of going on strike have virtually no bargaining power. Being such an influential power, the strike will inevitably affect the relevant sides, third persons and even the public opinion. Therefore it is of great importance to be thoroughly familiar with the actual meaning of the strike, it is relationship with the contract of service as well their effects on the latter for the sides. Particularly the workers and the unions who will bear the brunt of the consequences of strike must be familiar with them. We handled the effect of the strike on the contract of service in our present study. The effect of the strike on foreign law is excluded from our study. In the first part of the our present study, the right of strike and its' historical perspective, the strike concept, the elements of the legal strike and the elements of the illegal strike were dealt with. In the second part of the our study, the effect of the legal strike on the contract of service and its' consequences in Turkish Law were examined. In the third and the last part, the effect of the illegal strike on the contract of the service and its' consequences were examined in Turkish Law
