Özet
Bu çalışma, Türkiye'de kolluk kuvvetlerinin orantısız güç kullanımı, bağımsız kolluk şikâyet mekanizmalarının etkinliği ve Kolluk Gözetim Komisyonu'nun rolü üzerine odaklanmaktadır. Devletin güvenliği sağlama ve kamu düzenini koruma görevi, kolluk kuvvetlerine geniş yetkiler tanımayı zorunlu kılmıştır. Ancak bu yetkilerin sınırlarının belirsizliği ve denetim eksikliği, keyfi ve orantısız güç kullanımına zemin hazırlamaktadır. Orantısız güç kullanımı, bireylerin temel hak ve özgürlüklerini ihlal ederek hukuk devleti ilkesini zedelemekte, toplumun kolluk kuvvetlerine ve devlete olan güvenini sarsmaktadır. Bu ihlallerin önlenmesi ve ihlal durumlarında adaletin sağlanması, bağımsız ve etkin şikâyet mekanizmalarının varlığıyla mümkündür. Bu tezin temel amacı, Türkiye'deki kolluk kuvvetlerinin güç kullanımına ilişkin hukuki ve idari çerçeveyi analiz etmek, orantısız güç kullanımının nedenlerini, sonuçlarını ve önlenebilirliğini incelemek, ayrıca bağımsız kolluk şikâyet mekanizmalarının ve Kolluk Gözetim Komisyonu'nun bu bağlamdaki rolünü değerlendirmektir. Çalışma, kolluk kuvvetlerinin hesap verebilirliğini artırmak, keyfi ve orantısız güç kullanımını azaltmak ve vatandaşların hak arama yollarına erişimini güçlendirmek amacıyla çözüm önerileri sunmaktadır. Tez, Kolluk Gözetim Komisyonu'nun yapısı, işlevi ve bağımsızlık düzeyini detaylı bir şekilde ele alarak, bu yapının Türkiye'de kolluk kuvvetlerinin denetimi ve orantısız güç kullanımının önlenmesindeki etkinliğini sorgulamaktadır. Uluslararası standartlar çerçevesinde incelenen Kolluk Gözetim Komisyonu, demokratik toplumların güvenlik ve özgürlük arasındaki hassas dengesinin korunmasında önemli bir araç olarak öne çıkmaktadır. Ancak Türkiye'de bu mekanizmanın bağımsızlığı, tarafsızlığı ve yaptırım gücü açısından eksiklikleri incelenmiştir.

This study focuses on the disproportionate use of force by law enforcement agencies in Turkey, the effectiveness of independent law enforcement complaint mechanisms, and the role of the Law Enforcement Oversight Commission. The state's duty to ensure security and maintain public order has necessitated granting extensive powers to law enforcement agencies. However, the lack of clear boundaries for these powers and deficiencies in oversight have created a fertile ground for arbitrary and disproportionate use of force. The disproportionate use of force violates individuals' fundamental rights and freedoms, undermines the principle of the rule of law, and erodes public trust in law enforcement agencies and the state. Preventing such violations and ensuring justice in cases of misconduct are only possible through the existence of independent and effective complaint mechanisms. The primary objective of this thesis is to analyze the legal and administrative framework governing the use of force by law enforcement agencies in Turkey, examine the causes, consequences, and preventability of disproportionate force usage, and evaluate the role of independent law enforcement complaint mechanisms and the Law Enforcement Oversight Commission within this context. The study aims to propose concrete solutions to enhance the accountability of law enforcement agencies, reduce arbitrary and disproportionate use of force, and strengthen citizens' access to legal remedies. The thesis thoroughly examines the structure, functions, and independence level of the Law Enforcement Oversight Commission, questioning its effectiveness in overseeing law enforcement activities and preventing the disproportionate use of force in Turkey. Evaluated within the framework of international standards, the Law Enforcement Oversight Commission emerges as a significant tool for maintaining the delicate balance between security and freedom in democratic societies. However, the study identifies deficiencies in the independence, impartiality, and enforcement power of this mechanism in Turkey. In conclusion, this thesis emphasizes the urgent need for structural, legal, and administrative reforms to address the shortcomings of independent law enforcement complaint mechanisms and the Law Enforcement Oversight Commission in Turkey. Ensuring the independence of these mechanisms, enhancing their transparency, and making their decisions binding and enforceable are essential steps for protecting individual rights, strengthening public trust, and aligning security policies with democratic principles.
