Özet

Şantaj suçu, TCK'da“Hürriyete Karşı Suçlar”bölümü altında ele alınmıştır. Kavram olarak ilk defa 5237 sayılı TCK'da hayatımıza girmiştir. Ancak şantaj suçunun karşıladığı unsurlar itibariyle kısmen ETCK m.188 ve m.192 ile benzerlikler göstermektedir. Suçun ihlal ettiği değerler itibariyle çok boyutlu hukuki niteliğe sahiptir. İhdas edilen ceza normu irade ile mağdurun irade serbestisi ve malvarlığı değerleri korunmaktadır. Ancak irade hürriyetine yönelik saldırının egemen unsur olarak kabul edilmesi nedeniyle suçu kanun sistematiğinde“Hürriyete Karşı Suçlar”altında düzenlenmiştir. Bu çalışmanın amacı, şantaj suçunun kavramsal yönleriyle ele almayı, teorik temelini değerlendirmek suretiyle suçun yapısal özelliklerini ve uygulamadaki yansımalarını ortaya koymaktır. Şantaj suçu, kavramsal ve tarihsel gelişimi itibariyle ele alınmış, benzer suç tipleriyle olan irtibatı ve farklı hukuk sistemlerindeki yeri üzerinde durulmuştur. Ardından suçun maddi ve manevi unsurları ele alınmıştır. Son olarak ise, suçun özel görünüş şekilleri, kusurluluk ve kovuşturma usulüne dair temel meseleler incelenmiş; öğretideki farklı yaklaşımlar ve yargı kararları ışığında genel bir çerçeve sunulmuştur.

The offense of blackmail is addressed under the section titled“Crimes Against Liberty”in the Turkish Penal Code (TPC). As a legal concept, it was introduced into our legal system for the first time through Law No. 5237 of the TPC. However, in terms of its constituent elements, the offense of blackmail partially resembles Articles 188 and 192 of the former Turkish Penal Code. The values violated by this offense possess a multi-dimensional legal nature. The enacted criminal norm protects the victim's freedom of will as well as the values related to property. However, since the violation of freedom of will is accepted as the dominant element, the offense has been regulated within the scope of“Crimes Against Liberty”in the system of criminal law. The purpose of this study is to address the offense of blackmail from a conceptual standpoint, reveal its theoretical foundations, and highlight its structural characteristics and practical implications. The offense has been examined in terms of its conceptual and historical development, its relationship with similar types of crimes, and its place within different legal systems. Subsequently, the material and moral elements of the offense are discussed. Finally, this study analyzes the specific manifestations of the offense, the issue of culpability, and the fundamental aspects of the criminal procedure. A general framework is presented in light of different scholarly approaches and judicial decisions.
