Özet
Tezin konusunu“Hukuki Açıdan Modern Denize Elverişlilik Anlayışı”oluşturmaktadır. Çalışmada, deniz hukukunda denize elverişlilik kavramı kurumsal olarak incelenmekte, kendisine geçmişten günümüze biçilen anlam açıklanmakta ve güncel gelişmeler ışığında gelecekte kendisine atfedilmesi mümkün anlayış tespit edilmektedir. Tezde modern denize elverişlilik anlayışını ortaya koymak üzere, ilk bölümde, denize elverişlilik kurumunun ilk olarak hangi sebeplerle ortaya çıktığı, nasıl anlam kazandığı, ne gibi hüküm ve sonuçlar doğurduğu incelenmiştir. İkinci bölümde ise denize elverişlilik kurumunun evrimini gerektiren sebepler açıklanarak, günümüzde addedilen anlam hüküm ve sonuçlarıyla birlikte ele alınmıştır. Hukukun teknolojik gelişmelere kayıtsız kalamayacağından bahisle, modern denize elverişlilik anlayışının bir sonraki basamağını oluşturan denize elverişlilik kurumunun gelecekteki dönüşümüne yönelik olarak, çalışmanın üçüncü bölümünde, dijital sistemler ve yapay zekâyla çalışan yeni tip teknoloji barındıran gemilerin ve bu gemilerin kullanımı dolayısıyla ortaya çıkan siber risklerin denize elverişlilik kurumuna kattığı yeni anlam ve sonuçlar açıklanmıştır.

The subject of the thesis is“Modern Understanding of Seaworthiness from a Legal Perspective”. In this study, the concept of seaworthiness in the sea and maritime law is examined, its meaning from past to present is explained, and possible future interpretations are identified in light of current developments. To establish a modern understanding of seaworthiness, the thesis analyzes, in the first part, the reasons why the concept of seaworthiness first emerged, how it gained meaning, and what kind of provisions and consequences it has brought about. In the second part, the reasons that necessitated the evolution of the concept of seaworthiness are explained and its current meaning is discussed together with its provisions and consequences. Recognizing that law cannot remain indifferent to technological advances, the third part of the study explains the new meanings and consequences introduced to the concept of seaworthiness by ships equipped with digital systems, by ships featuring new types of technology operating with artificial intelligence, and by the cyber risks arising from the use of such ships. These developments collectively constitute the next stage in the modern understanding of seaworthiness.
