Özet
Nesih, tefsir usûlünde önemli konulardan biridir. Zira neshin gerek Kur'ân'ın anlaşılmasında gerekse hüküm çıkarmada büyük ehemmiyet arz ettiği aşikârdır. Bu tezde Cessâs, Herrâsî ve İbnü'l-Arabî'nin ahkâm tefsirlerinden hareketle nesih hususuna dair yaklaşımları ele alınmıştır. Giriş bölümünde çalışmanın amacı, önemi, yöntemi, kapsam ve müracaat edilen kaynaklar zikredilmiştir. Birinci bölümde ise, teorik olarak mezkûr müfessirler bağlamında neshin tanımı ve anlam çerçevesi, konuluş hikmeti, imkânı, neshi kabul edenlerin delilleri, nesih ile ilişkili diğer kavramlar incelenmiştir. Yine bu bölümde üç müfessire göre neshin şartları, neshin hakikatine dair bazı yaklaşımları ayrıntılı olarak belirtilmiştir. İkinci bölümde ise Cessâs, Herrâsî ve İbnü'l-Arabî'nin nesih ile ilgili pratik uygulamaları ele alınmıştır. Onların bu uygulamaları, ibadetler, muamelat, cihâd ve barış hukuku, yasaklar ve cezalar (ukûbât) konularına dair örnekler ile izah edilmiştir. Sonuç olarak bu çalışmada zikredilen üç âlimin perspektifinden nesih meselesine yaklaşımları gözler önüne serilmiştir. Böylece mezkûr âlimlerin görüşleri incelenerek müntesibi oldukları Hanefî, Şâfiî ve Mâlikî fıkhî mezhepleri bağlamında nesih konusuna bakışları ortaya konmuştur.

Naskh (Nesh) is one of the important topics in the methodology of interpretation. It is obvious that naskh is of great importance both in understanding the Quran and in deriving rulings. n this thesis, the approaches of Al-Jassās, al- Harrāsī, and Ibn Arabī to the issue of naskh are discussed, based on their interpretations of the rulings. In the introduction section, the purpose, importance, method, scope and referenced sources of the study are mentioned. In the first part, the definition and meaning framework of naskh, the wisdom behind its introduction, its possibility, the evidence of those who accept naskh, and other concepts related to naskh are examined theoretically in the context of the aforementioned commentators. Again, in this section, the conditions of naskh and some approaches to the truth of naskh according to three commentators are explained in detail. In the second part, the practical applications of al-Jassās, al-Harrāsī and Ibn al-Arabī regarding naskh are discussed. Their practices are explained with examples of worship ('ibādāt), transactions (ʿuqūbāt), jihād and peace (ṣulḥ) law, prohibitions and punishments (ukubāt). As a result, the approaches to the issue of naskh from the perspective of the three scholars mentioned in this study are revealed.
