Özet

Ortaçağ'da sanat ile teknik; sanatçı ile zanaatçı arasında belirgin bir söylemsel ayrım bulunmamaktadır. Bu dönemde bir yapı ustası, zanaatçı niteliğiyle eser üreten, müellif olarak adı bilinmeyen isimsiz bir tasarımcıdır. Ancak bu durum, aynı çağda mülkiyet ilişkilerinde yaşanan dönüşümle, dolayısıyla ekonomik süreçlerin etkisiyle değişmeye başlamıştır. İlk kırılma, İtalya'da kolektif üretim biçiminden ayrılarak kendi tasarımı üzerinden isim kazanmaya başlayan Ortaçağ'ın gezgin zanaatçılarına verilen tekel patentleri ve kral mektupları gibi imtiyazlar aracılığıyla gerçekleşmiştir. İkinci kırılma ise, sanatçının öncül figür haline gelmesine olanak sağlayan mülkiyet ilişkilerinin oluştuğu Rönesans döneminde yaşanmıştır. Bu dönemde“deha sanatçı”figürü öne çıkmış; sanatçıların adları bilinmeye başlanmış ve onlar adına kitaplar yazılmıştır. Böylece sanatçının tekil ve özgün üretimleri üzerinden toplumsal ve ekonomik ilişkiler şekillenmiştir. Avrupa'da 15.yy'da ortasında matbaanın kullanımı, kitapların ve sanatsal üretimlerin çoğaltılarak birçok Avrupa kentine yayılmasını kolaylaştırmış; bu gelişme ile müellif, loncalara bağlı basımevlerine müelliflik haklarını devretmeye başlamıştır. Böylece, edebi alanda kopya üzerinden telif korumasının kabulüne olanak sağlayan koşullar gelişmiştir. 15. yüzyılda Alberti (1988), mimarı düşünsel üretim yapan bir müellif olarak tanımlamış; onu hem zihinsel hem bedensel emeği kullanan uygulayıcı zanaatçıdan ayırarak, yalnızca zihinsel emeği üzerinden yüceltmiştir. Bu durum, mimarı bir“author”(müellif ya da otorite) olarak yücelten anlayıştan ve mimarın bir uygulayıcı olduğunu ileri süren Vitruvius'un yaklaşımından söylemsel bir ayrışma biçimi olarak değerlendirilebilir. 17. yüzyılın sonunda kapitalist üretim ilişkilerinin gelişmesiyle birlikte, tarihsel sürecin hukuki açıdan en önemli eşiği, 1709 yılında İngiltere'de kabul edilen Anne Yasası olarak değerlendirilmektedir. Bu yasa, yalnızca edebi müelliflere ilk kez yasal telif hakkı tanımakla kalmamış; aynı zamanda müellif figürünü hukuksal düzeyde kurumsallaştırmıştır. Bu yasada, eserlerin kopyalanmasının engellenmesine yönelik olarak seçilen 'copy' (kopya) terimi ile dönemin kapitalist basımevlerinde kullanılan 'copy right' (kopya hakkı) ifadesi, günümüzde yasanın 'copyright' olarak adlandırılmasına zemin hazırlamıştır. 18. yüzyılın sonunda taş baskı tekniğiyle birçok harita, resim ve çizimin basılarak çoğaltılması, telif haklarının yalnızca yazılı metinlerle sınırlı kalmayıp çeşitli meslek alanlarını da kapsamasına yol açmıştır (Bozgeyik, 2019). 19. yüzyılda bu kurumsallaşma, birçok Avrupa ülkesine yayılmış; kabul edilen uluslararası sözleşmelerle birlikte telif yasaları mimari çizimlerin sahiplerini de içine alacak biçimde genişletilmiştir. Mimarlığın bir sektör haline geldiği 20. yüzyılın başında ise, uygulanmış mimarlık eserlerinin tasarımcıları, uluslararası yasalar çerçevesinde hukuki olarak koruma altına alınmıştır (Bozgeyik, 2019). Bu bağlamda, telif yasalarının mimarın özgün eser üretimini teşvik etmesi ve onun maddi ve manevi haklarını koruması, söz konusu tarihsel dönüşümde belirleyici bir rol oynamaktadır. Telif ya da fikri mülkiyet hakkı, eser sahibine zihinsel emeğiyle oluşturduğu eser üzerinden tanınan maddi ve manevi haklardan oluşmaktadır. Avrupa menşeli“author”kelimesinin Türkçe karşılığı olan“müellif”ile, 'authorship' terimine karşılık gelen 'müelliflik, telif' kavramları, benzer anlamları yansıtmaktadır.Günümüzde Türkiye'de mimarlık alanında da kullanılmaya devam eden 'müellif' kavramı, 'eser yazarı' anlamının yanı sıra, 'mü' ve 'elif' bileşimi üzerinden (Nişanyan, 2018) 'ilk yapan' ve 'otorite sahibi' şeklinde de yorumlanmaktadır. Bu anlamıyla 'müellif', etimolojik olarak“author–authority”ilişkisinde olduğu gibi, otorite kuran yaratıcı bir özneye işaret etmektedir. Bu tez çalışması, mimarın telif yasaları sonucunda“müellif”olarak adlandırılmasına neden olan tarihsel ve söylemsel koşulları ortaya koymayı amaçlamaktadır. Çalışmada ele alınan temel problemler; Türkiye'de mimarın 'müellif' statüsü kazanmadan kendi tasarımlarını gerçekleştirememesi ve müellifliğin, mimari yarışmalar dışında yalnızca büro sahibi mimara tanınan bir hak olarak, doğrudan mülkiyet ilişkilerinin aracı haline gelmesidir. Foucault'nun (2014) da ifade ettiği üzere, müellif kavramının kazandırdığı söylemsel güç, mimarı sanatsal yeteneğinden ziyade siyasi ve ekonomik ilişkileri üzerinden nesneleştirmektedir. İktidar söyleminin bir yansıması olarak, günümüzde de geçerliliğini koruyan telif ya da müellif hakları, kimi zaman mimarın mimari eserinin yıkımına da neden olmasına zemin hazırlamaktadır. Bu bağlamda, tezin hipotezi, günümüz mimari pratikleri üzerinden Türkiye'de mimarın telif hakkı aracılığıyla kendi öznesine, eserine ve topluma yabancılaştığını; dolayısıyla telif kavramının mimari yaratıcılığı bütünüyle kapsamakta yetersiz bir çerçeve sunduğunu ileri sürmektedir. Başka bir deyişle, öznenin Foucault'nun deyişiyle (Foucault, 2014) 'müellif-işlevi'ne dönüştüğü tarihsel süreçte; otorite müellif, yaratıcılığını iktidarın ondan istediği biçime uyumlu olarak üretmekte ve ürettiği eseri araçsallaştırarak onun kendi tasarısı olduğuna yabancılaşmaktadır. Spinoza'nın (2019) düşüncelerine benzer bir bakışla, mimar, önce dışsallaşarak zihinsel üretimlerini doğaya sunduğu içkin bir özgürlük anlayışına sahipken; Hegel'in (2006) bakışı doğrultusunda, bu zihinsel emeği kamuya sunduğunda onu nesneleştirmektedir. Bu süreç, Marksist (2011) bir anlayışla, eserin metalaşmasına giden süreci yaratmaktadır. Çünkü o mimari eser, kolektif ve kitlesel bir üretim süreciyle meydana gelmektedir. Başka bir deyişle, toplumsal iş bölümü sonucunda ortaya çıkan mimari üretim, neoliberal piyasa koşullarına sunulduğunda,“eser”niteliği değişim değeri üzerinden metalaşmakta; imgeler, markalar ve ideolojik iktidar söylemleri aracılığıyla yeniden şekillenmektedir. Bu yabancılaşma, üretilen eserin kendisinden ziyade müellif mimarın (starchitech) star mimar figüründe olduğu gibi fetişleştirilmesini de beraberinde getirmektedir (Adjaye, Hirsch ve Otero-Pailos, 2011). Bu bağlamda, mimarın hem kendisine hem de topluma yabancılaşma durumu ile mimarın bir fetiş nesnesine dönüşmesi; müelliflik ve telif kavramlarının ortaya çıktığı koşullar çerçevesinde değerlendirilecektir. Bu değerlendirme, mimari dergilerdeki söylemler, yasal düzenlemeler, tarihsel ve ekonomik bağlamlar üzerinden yürütülecek; konu, tarihsel, hukuki, sanatsal ve mimari olmak üzere çok katmanlı bir perspektiften ele alınacaktır. Bu çerçevede, ilk olarak; dışsallaşma ve yabancılaşma kavramları, Spinoza, Hegel ve Marx'ın söylemlerinde tanımlanarak; önce meta fetişizmi kavramı Lukacs'ın ve Benjamin'in kültürel ve sanatsal (2015); Lefebvre'nin metalaşan mekan (2014); Baudrillard'ın birey açısından (2016) ve Foucault'nun söylemsel değerlendirmeleri ekseninde (Foucault, 2014) ele alınacaktır. İkinci olarak; yazar ile okuyucu arasında ya da sanatçı ile eseri arasındaki yabancılaşma söylemleri ekseninde; müellifin metin içindeki varlığının metaforik olarak sona erdiğini belirten Barthes (2013) ve telif hakkını reddederek eserini hazır-yapıt olarak sunan Duchamp (1989)'ın düşünüşleri incelenecektir. Bu felsefi incelemede ayrıca; tarihsel süreçte müellifin iktidar söylemleri aracılığıyla bir işleve indirgenip nesneleştiğini vurgulayan Foucault (2014) ve okurun metin üzerinden her an müellif konumuna geçebilmesinin; müellifin eserine yabancılaşmasına yol açtığını dile getiren Benjamin (2015) ve müellifin metinden tamamen silinmediğini ve önceki yazarlar gibi bir“iz”olarak varlığını sürdürdüğünü ifade eden Derrida'nın (2020) düşünceleri irdelenecektir. Tezde izlenen araştırma yöntemlerinin ilki, Koselleck'in (2009) kavram tarihi yaklaşımıdır. Bu yöntem çerçevesinde,“müellif”ve“telif”kavramlarının nasıl, ne zaman, hangi toplumsal ve tarihsel bağlamlarda ve kimler için ortaya çıktığı, disiplinlerarası bir biçimde incelenecektir. İkinci yöntem ise, kavramsal tarih analizini tamamlayıcı nitelikte ele alınacak olan Foucault'nun (2004) soybilimsel araştırma yaklaşımıdır. Soybilimsel çözümleme aracılığıyla, söz konusu kavramların tarihsel süreçte geçirdiği etimolojik dönüşümler ile bu dönüşümlerin dönemin mülkiyet ilişkileri bağlamında nasıl şekillendiği; zanaatçıdan mimara, mimardan müellife evrilen özne üzerinden değerlendirilecektir. Geniş bir literatür incelemesinin yapıldığı tezde, üçüncü yöntem olarak Türkiye'de yayımlanmış Arkitekt ve Mimarlık dergilerinde arşiv taraması yapılacaktır. Burada, mimarların kendi tasarımlarını anlatan yazılar ve dönemin eleştirel metinleri üzerinden içerik analizleri gerçekleştirilerek bu kavramların izleri sürülecektir. Altı bölümden oluşan çalışmanın birinci bölümünde, giriş başlığı altında araştırma problemi, hipotezi, amacı ve yöntemi açıklanmıştır. İkinci bölümde ise felsefi düşünüşler başlığı altında, iki alt başlıkta çeşitli düşünürlerin görüşleri doğrultusunda tartışmalar yürütülmüştür. Bu bağlamda, ilk alt başlık olan meta fetişizmi, Lukács'ın ve Benjamin'in kültürel ve sanatsal; Lefebvre'nin mekansal, Baudrillard'ın birey üzerine ve Foucault'nun söylemsel değerlendirmeleri ekseninde ele alınmıştır. Müellif ile okuyucunun ya da kullanıcının yabancılaşması ise, Benjamin, Duchamp, Barthes, Foucault ve Derrida'nın müellif söylemleri üzerinden değerlendirilmiştir. Üçüncü bölüm iki başlık altında kurgulanmıştır. İlkin, Avrupa'daki mülkiyet ilişkileri çerçevesinde müelliflik ve telif kavramları; zanaatçının müellife dönüşümü ve sanatçının kimliğinin görünür hale gelmesi üzerinden, çok katmanlı bir biçimde ve üç alt başlık altında incelenmiştir. İkinci olarak incelenen konu, Osmanlı Devleti'nden Türkiye Cumhuriyeti'ne uzanan süreçte bu kavramların nasıl şekillendiği, farklı müellif tanımlarının ne şekilde ortaya çıktığı, anonim zanaatçıdan isim sahibi müellife dönüşüm ve mimarın hukuki olarak müellife evrilmesidir. Üç bölümden oluşan Türkiye'deki incelemenin hukuki katmanında; Osmanlı'dan günümüze kadar telif korumasının mimarla kurduğu ilişkiler; yasalar, mevzuatlar, meclis tutanakları ve yasa taslakları üzerinden analiz edilmiştir. Dördüncü bölüm, ilk üç bölümde müellif ve telifle ilişkili olarak ele alınan tarihsel, felsefi ve güncel sorunların bir araya getirildiği ilişkisel yaklaşım çerçevesinde haritalandırılmış; ayrıca, müellifliğin tekil otoritesine karşılık kolektif müelliflik ilişkilerini içeren bazı mimari temsiller ve uygulamalar incelenmiştir. Tezin beşinci bölümünde, Türkiye'de yayımlanan ilk mimarlık dergisi Arkitekt (1931–1980) ile 1963'ten günümüze yayımlanan Mimarlık Dergisi müelliflik, telif ve bu kavramların söylemsel inşaları bakımından incelenmiş; her iki dergideki örnekler ise önceki bölümde geliştirilen ilişkisel yaklaşım ışığında ve bu bölümdeki söylemsel haritalama çerçevesinde karşılaştırmalı olarak değerlendirilmiştir. Altıncı ve son bölümde ise, araştırmanın genel değerlendirmesi yapılmış ve ulaşılan sonuçlara yer verilmiştir. Sonuç olarak, Bu tez, Türkiye'de mimarın telif ve müellif kavramlarıyla geçirdiği dönüşümü ve bu sürecin yeni kavramlarla biçimlenişini ortaya koymaktadır. Çalışma, günümüz telif tartışmaları bağlamında mimar temsilini kavramsal düzeyde sorgularken, kültürel mirasın korunması, özgün ve kolektif üretimlerin desteklenmesine yönelik çözüm önerileri sunmaktadır. Böylece, mimarlık literatüründe sınırlı olan bu alana kuramsal bir katkı sağlanacağı düşünülmektedir.

In the Middle Ages, there was no clear distinction between art and technique, or between artists and craftsmen. During this period, a master builder was an anonymous designer who produced works as a craftsman, without being known by name as an author. However, this situation began to change due to the transformation in property relations during the same period, and consequently, the impact of economic processes. The first break occurred in Italy through privileges such as monopoly patents and royal letters granted to medieval itinerant artisans who began to make a name for themselves through their own designs, moving away from collective production. The second break occurred during the Renaissance, when property relations emerged that enabled the artist to become a leading figure. During this period, the figure of the“genius artist”came to the fore; artists' names became known, and books were written about them. Thus, social and economic relations were shaped through the individual and original productions of artists. In the mid-15th century in Europe, the use of the printing press facilitated the reproduction of books and artistic productions and their dissemination to many European cities; with this development, authors began to transfer their authorship rights to printing houses affiliated with guilds. Thus, conditions developed that allowed for the acceptance of copyright protection through copies in the literary field. In the 15th century, Alberti (1988) defined the architect as an author engaged in intellectual production; he distinguished him from the practitioner-artisan who used both mental and physical labor, elevating him solely on the basis of his mental labor. This situation can be seen as a discursive divergence from the understanding that glorified the architect as an“author”(author or authority) and from Vitruvius' approach, which argued that the architect was a practitioner. With the development of capitalist production relations at the end of the 17th century, the most important legal milestone in this historical process is considered to be the Statute of Anne, passed in England in 1709. This law not only granted legal copyright to literary authors for the first time, but also institutionalized the figure of the author at the legal level. The term 'copy' chosen in this law to prevent the copying of works and the expression 'copy right' used in the capitalist printing houses of the period laid the groundwork for the law to be called 'copyright' today. At the end of the 18th century, the printing and reproduction of many maps, pictures, and drawings using lithography led to copyrights extending beyond written texts to cover various professional fields (Bozgeyik, 2019). In the 19th century, this institutionalization spread to many European countries; with the adoption of international treaties, copyright laws were expanded to include the owners of architectural drawings. At the beginning of the 20th century, when architecture became an industry, the designers of implemented architectural works were legally protected under international laws (Bozgeyik, 2019). In this context, copyright laws play a decisive role in this historical transformation by encouraging architects to produce original works and protecting their material and moral rights. Copyright or intellectual property rights consist of the material and moral rights granted to the author of a work for the intellectual effort invested in its creation. The Turkish equivalent of the European term“author,”“müellif,”and the concepts of 'authorship' and“copyright,”reflect similar meanings. The concept of“müellif,”which continues to be used in the field of architecture in Turkey today, is interpreted not only as“author of a work”but also as“the first to do”and“authority holder”through the combination of 'mü' and“elif”(Nişanyan, 2018). In this sense,“author”etymologically points to a creative subject who establishes authority, as in the“author–authority”relationship. This thesis aims to reveal the historical and discursive conditions that led to architects being called“authors”as a result of copyright laws. The main problems addressed in the study are that architects in Turkey cannot realize their own designs without acquiring the status of 'author' and that authorship, as a right granted only to architects who own a firm outside of architectural competitions, has become an instrument of direct property relations. As Foucault (2014) also states, the discursive power conferred by the concept of author objectifies the architect through political and economic relations rather than artistic talent. As a reflection of the discourse of power, copyright or author's rights, which remain valid today, sometimes pave the way for the destruction of the architect's work. In this context, the thesis's hypothesis argues that, through contemporary architectural practices in Turkey, the architect becomes alienated from their own subject, their work, and society through copyright; therefore, the concept of copyright offers an inadequate framework to fully encompass architectural creativity. In other words, in the historical process where the subject is transformed into what Foucault calls the 'author-function' (Foucault, 2014), the author-function produces creativity in a form compatible with what power demands of them and alienates themselves from their own design by instrumentalizing the work they produce. Similar to Spinoza's (2019) ideas, the architect, who initially possesses an immanent understanding of freedom by externalizing and presenting their mental productions to nature, objectifies this mental labor when presenting it to the public, in line with Hegel's (2006) perspective. This process, in a Marxist (2011) sense, creates the process leading to the commodification of the work. This is because the architectural work is created through a collective and mass production process. In other words, when architectural production, which emerges as a result of the social division of labor, is presented under neoliberal market conditions, the“work”is commodified through its exchange value; it is reshaped through images, brands, and ideological discourses of power. This alienation also brings with it the fetishization of the author-architect (starchitech) as a star architect figure, rather than the work itself (Adjaye, Hirsch, and Otero-Pailos, 2011). In this context, the architect's alienation from both themselves and society, and their transformation into a fetish object, will be evaluated within the framework of the conditions under which the concepts of authorship and copyright emerged. This assessment will be conducted through discourses in architectural journals, legal regulations, and historical and economic contexts; the subject will be approached from a multi-layered perspective: historical, legal, artistic, and architectural. In this context, first, the concepts of externalization and alienation will be defined in the discourses of Spinoza, Hegel, and Marx; then, the concept of commodity fetishism will be examined in the cultural and artistic discourses of Lukacs and Benjamin (2015); Lefebvre's commodified space (2014); Baudrillard's perspective on the individual (2016), and Foucault's discursive evaluations (Foucault, 2014). Secondly, within the discourse of alienation between the author and the reader or between the artist and the work, the thoughts of Barthes (2013), who states that the author's presence in the text has metaphorically come to an end, and Duchamp (1989), who rejects copyright and presents his work as ready-made, will be examined. This philosophical analysis also examines Foucault's (2014) emphasis on how, throughout history, the author has been reduced to a function and objectified through discourses of power, and Benjamin's (2015) assertion that the reader's ability to assume the author's position at any moment through the text leads to the author's alienation from their work. (2015), who states that the reader can instantly assume the position of the author through the text, leading to the author's alienation from their work, and Derrida (2020), who states that the author is not completely erased from the text and continues to exist as a“trace”like previous writers. The first research method followed in the thesis is Koselleck's (2009) conceptual history approach. Within this framework, the concepts of“author”and“copyright”will be examined in an interdisciplinary manner: how, when, in which social and historical contexts, and for whom they emerged. The second method is Foucault's (2004) genealogical research approach, which will be considered as complementary to conceptual historical analysis. Through genealogical analysis, the etymological transformations these concepts underwent throughout history and how these transformations were shaped within the context of property relations of the period will be evaluated through the subject evolving from craftsman to architect to author. In this thesis, which includes an extensive literature review, the third method will be archival research in Arkitekt and Mimarlık magazines published in Turkey. Here, content analyses will be conducted based on architects' writings describing their own designs and critical texts of the period to trace the origins of these concepts. The first section of the six-part study, under the heading“Introduction,”explains the research problem, hypothesis, purpose, and method. The second section, under the heading“Philosophical Reflections,”discusses the views of various thinkers under two subheadings. In this context, the first subheading, meta-fetishism, is addressed based on the cultural and artistic assessments of Lukács and Benjamin, Lefebvre's spatial assessments, Baudrillard's assessments of the individual, and Foucault's discursive assessments. The alienation of the author from the reader or user is evaluated through the discourses of Benjamin, Duchamp, Barthes, Foucault, and Derrida. The third chapter is structured under two headings. First, authorship and copyright concepts within the framework of property relations in Europe are examined in a multi-layered manner under three subheadings: the transformation of the craftsman into an author and the emergence of the artist's identity. The second topic examined is how these concepts took shape in the process from the Ottoman Empire to the Republic of Turkey, how different definitions of authorship emerged, the transformation from anonymous craftsman to named author, and the legal evolution of the architect into an author. The legal layer of the three-part study in Turkey analyzes the relationship between copyright protection and architects from the Ottoman period to the present day through laws, regulations, parliamentary records, and draft legislation. The fourth chapter maps the historical, philosophical, and contemporary issues related to authorship and copyright discussed in the first three chapters within a relational approach; it also examines some architectural representations and practices that involve collective authorship in contrast to the singular authority of authorship. In the fifth chapter of the thesis, Arkitekt (1931–1980), the first architecture journal published in Turkey, and Mimarlık Dergisi, published from 1963 to the present, are examined in terms of authorship, copyright, and the discursive constructions of these concepts. and examples from both journals are evaluated comparatively in light of the conceptual approach developed in the previous chapter and within the framework of the discursive mapping in this chapter. The sixth and final chapter provides an overall assessment of the research and presents the findings. In conclusion, this thesis reveals the transformation that architects in Turkey have undergone with the concepts of copyright and authorship and how this process has been shaped by new concepts. While questioning the representation of architects at a conceptual level in the context of contemporary copyright debates, the study offers solutions for the preservation of cultural heritage and the support of original and collective productions. Thus, it is believed that this thesis will provide a theoretical contribution to this limited area in architectural literature.
