Özet
Hukukumuzda kısa çalışma uygulaması; genel ekonomik, sektörel, bölgesel kriz, genel salgın veya zorlayıcı sebeplerin varlığı durumunda toplumsal refah seviyesini koruma, ekonomik hayatı koruma, işletmelerin devamlılığını sağlama, iş sözleşmelerinin feshedilmesini önleme, işçilere gelir güvencesi sağlama ve işsizliği önleme gibi iş hayatına ilişkin feshin son çare olması kapsamında bir çözüm yolu olarak düzenlenmiş ve globalleşen dünya ile teknolojik gelişmeler, beklenmeyen dış etkenler gibi deneyim ve durumlar karşısında sürekli mevzuat kapsamında da güncellenen bir uygulama olmuştur. Kısa çalışma uygulaması geçmişten günümüze birçok kriz dönemlerinde icra edilmiş, ülkemizde en aktif dönemi de Covid-19 koronavirüs pandemisi dönemi olmuştur. Bu kapsamda çalışmamızda kısa çalışmanın geçmişten günümüze mevzuattaki gelişimi, diğer ülkelerle karşılaştırılması, kavramsal nitelendirilmesi, hukuki niteliği, amaçları, benzer kurumlarla karşılaştırılması, uygulamadaki mevzuatın zorunlu tuttuğu kriterler ve prosedürler, iş sözleşmelerine etkileri, uygunsuzluk halinde yaptırımları, sosyal güvenlik hakları gibi alanlarda geniş anlamda incelemesi yapılarak kısa çalışma düzenlemeleri detaylı olarak değerlendirilmiş ve hem uygulama eğilimleri hem de hukuki anlamda içerik ve detayları tezimizde anlatılmıştır.

In our legal system, the short-time working practice is regulated as a solution under the concept that termination of employment contracts should be a last resort in the context of protecting the social welfare level, safeguarding economic life, ensuring the continuity of businesses, preventing the termination of employment contracts, providing income security to workers, and preventing unemployment, in the presence of general economic, sectoral, regional crises, general pandemics, or force majeure situations. It has been a practice that is continuously updated within the framework of legal regulations in response to experiences and situations such as globalization, technological developments, and unforeseen external factors. The short-time working practice has been implemented during various crisis periods throughout history, with its most active period in our country being during the Covid-19 coronavirus pandemic. In this context, our study examines in detail the development of short-time work regulations from past to present, its comparison with other countries, its conceptual classification, legal nature, objectives, comparison with similar institutions, the mandatory criteria and procedures required by the regulations in practice, its effects on employment contracts, penalties for non-compliance, social security rights, and other related areas. The study provides a comprehensive analysis of short-time working regulations, and both the trends in practice and the legal content and details are explained in our thesis.
