Özet
Kasıt, Türk Ceza Kanunu m. 21'de bilme ve isteme unsurlarından müteşekkil olarak tarif edilmiştir. İsteme unsurunun varlığı, üzerinde çokça tartışmanın yapıldığı ayrı bir araştırma konusudur. Bu çalışmada sadece kastın bilme unsuru esas alınarak bunun kapsamına dair ortaya çıkan problemler ele alınmıştır. Mesele her ne kadar kastın tek bir unsuruyla sınırlandırılmış gibi görünse de kastı engelleyen hata başta olmak üzere pek çok dogmatik problemin bilme unsurundan sadır olması sebebiyle ceza hukukunun genel kısmına ilişkin çok sayıda konu hakkında inceleme yapma zarureti hasıl olmuştur. Bu istikamette evvela kastın bilme unsuruna dair dogmatik esaslar ele alınmış, bu bağlamda kastın suç şemasındaki konumu kanuni düzenlemeler temel alınarak tayin edilmiştir. Ardından bilme ve kasıt arasındaki ilişki irdelenmiş ve kastın bilme unsurunun kapsamına olgu bilgisinin dâhil olduğu tespit edilmiştir. Bu tespitten hareketle olgu bilgisinin nasıl elde edilebileceği ayrıca tetkik edilerek duyusal ve zihinsel olarak kavranabilen olgular özelinde açıklamalar yapılmıştır. Kastın bilme unsuruna ilişkin esaslar belirlendikten sonra suç şemasındaki sıralama takip edilerek ceza hukukunun genel kısmına ilişkin konularla kastın bilme unsuru arasındaki rabıta ortaya konulmuştur. Son olarak bu şemanın kapsamının dışında kalan fakat ayrıca tetkiki lazım gelen özel durumlarda kastın bilme unsurunun kapsamı tespit edilerek çalışma nihayete erdirilmiştir. Neticede çalışma boyunca ortaya çıkan problemlere, olgusal kasıt anlayışı görüşünün zaviyesinden çözümler aranmıştır.

Intent is defined in Article 21 of the Turkish Criminal Code as consisting of the elements of knowledge and will. The existence of the will element is a separate subject of research that has been widely discussed. In this study, only the knowledge element of intent is taken as the basis, and the problems arising regarding its scope are addressed. Although the matter seems to be limited to a single element of intent, it has become necessary to examine many issues concerning the general part of criminal law, since many dogmatic problems – particularly mistakes regarding intent – originate from the knowledge element. In this direction, first, the dogmatic foundations of the knowledge element of intent are discussed, and within this framework, the position of intent in the crime scheme is determined on the basis of legal regulations. Then, the relationship between knowledge and intent is examined, and it is established that factual knowledge is included within the scope of the knowledge element of intent. Proceeding from this finding, how such factual knowledge can be obtained is also investigated, with explanations made specifically concerning facts that can be apprehended sensually and mentally. After the principles concerning the knowledge element of intent are determined, the sequence within the crime scheme is followed to reveal the connection between issues of the general part of criminal law and the knowledge element of intent. Finally, in special situations that fall outside the scope of this scheme but nevertheless require separate examination, the scope of the knowledge element of intent is determined, and the study is brought to a conclusion. As a result, solutions are sought throughout the study from the perspective of the adopted concept of factual intent.
