Özet
Bu tez, Yeni Krallık dönemi (MÖ 1539–1077) özelinde Eski Mısır'da suç ve ceza olgusunu, evrensel düzeni temsil eden maat ile kaosun-kötülüğün karşılığı olan isfet kavramları ekseninde Dinler Tarihi perspektifinden incelemeyi amaçlamaktadır. Araştırma, Eski Mısır hukuk sisteminin teopolitik bir nitelik taşıdığını ve suçun yalnızca bireysel bir hak ihlali ya da toplumsal düzenin bozulması anlamına gelmediğini aynı zamanda evrensel dengeyi tehdit eden kozmik bir saldırı olarak değerlendirildiğini ortaya koymaktadır. Bu doğrultuda cezanın da salt bir ıslah veya caydırma işlevi gütmeyip sarsılan kozmik düzeni yeniden tesis etme ve tanrısal otorite ile toplumsal uyumu restore etme işlevi taşıdığı tespit edilmiştir. Vakaların suçun yöneldiği özneye göre tasnif edildiği tez, tanrılara, krala ve kişilere karşı işlenen suçları ve bu suçların yaptırımlarını birincil kaynaklardan (mahkeme kayıtları, kraliyet fermanları, Öğreti Metinleri, Cenaze Literatürü ve arkeolojik veriler) hareketle analitik bir perspektifle ele almaktadır. Çalışma boyunca suç-günah ayrımının Eski Mısır düşüncesinde birbiriyle iç içe geçtiği ve maat ile isfetin kozmik, siyasi, toplumsal ve bireysel düzeylerde tezahür eden dinamik bir kavram olduğu gösterilmektedir.

This dissertation aims to examine the phenomenon of crime and punishment in Ancient Egypt, specifically during the New Kingdom period (1539–1077 BCE), from the perspective of the History of Religions, focusing on the concepts of maat—representing universal order—and isfet—the counterpart of chaos and evil. The research demonstrates that the Ancient Egyptian legal system possessed a theopolitical nature and that crime was not merely viewed as an individual violation of rights or a disruption of social order, but was also assessed as a cosmic attack threatening the universal balance. In this context, it has been determined that punishment does not serve merely a rehabilitative or deterrent function, but rather carries the function of reestablishing the disrupted cosmic order and restoring harmony between divine authority and society. The thesis, which classifies cases according to the subject of the crime, analyzes crimes committed against the gods, the king, and individuals, as well as the penalties for these crimes, from an analytical perspective based on primary sources (court records, royal decrees, doctrinal texts, funerary literature, and archaeological data). Throughout the study, it is demonstrated that the distinction between crime and sin is intertwined in Ancient Egyptian thought, and that maat and isfet is a dynamic concept manifesting at cosmic, political, social, and individual levels.
