Özet
Devletlerin hukuk kurallarına uyum anlayışını güvence altına alabilmek için doğanın haklarının sürdürülebilir kalkınma kapsamında ele alınması önemlidir. Gabčíkovo-Nagymaros davasında, Uluslararası Adalet Divanı (UAD) tarafından da belirtildiği üzere sürdürülebilir kalkınma, çevrenin korunması ve ekonomik kalkınma arasında bir uzlaşıdır. Clark'a göre ise doğanın korunması için en ikna edici argüman, ekonomidir. Ekonomik tartışmalar ışığında bu çalışmada doğanın haklarının doğal kaynaklarının kullanımına engel olmadığı ortaya konmuştur. Doğanın haklarının arka planındaki temel fikir, ekolojik sistemlerin bütünlüğünün korunmasıdır. Böylece doğanın hakları esasen doğal kaynakların sömürülmesini engelleyerek ekonomik kalkınmaya destek olacaktır. Böylece çevre odaklı hukuk devletinin ikinci işlevi olan çevrenin korunması ayrıca değerlendirilebilir. Buna karşılık UAD tarafından kabul edildiği üzere uluslararası teamülün de bir parçası olan devletlerin doğal kaynaklar üzerindeki egemenliği, doğanın hakları bakımından engel yaratmaktadır. Bu noktada çevresel problemlerin devletlerin doğal kaynaklar üzerindeki egemenliğini de tehdit ettiğinin altı çizilmelidir. UAD, İklim Değişikliği Kapsamında Devletlerin Yükümlülükleri Danışma Görüşü'nde bilimsel verileri de göz önüne alarak iklim değişikliğinin devletlerin doğal kaynaklar üzerindeki egemenliğini etkilediğini ifade etmiştir. Böylece eğer iklim değişikliği karşısında doğanın hakları uluslararası hukukta kabul edilirse devletlerin egemenliğini korumaya yardımcı olabilir. Çevre odaklı hukuk devleti altında çevrenin korunmasını güvence altına almak için doğanın hakları doğal kaynakların sömürüsünü engelleyecek şekilde tanınmalıdır. Bu değerlendirmeler ışığında bu çalışma, her ne kadar devletlerin egemenliği uluslararası hukukun merkezinde yer alsa da doğanın hakları ile devlet egemenliği arasındaki uzlaşının, çevre odaklı hukuk devleti anlayışına ulaşma bakımından destekleyici olduğunu göstermektedir. Doğanın haklarının, egemenliği koruyucu bir hukuki araç olabileceği de göz önüne alınmalıdır. En nihayetinde doğanın hakları, doğanın sömürüsü anlayışından uzaklaşarak doğanın korunması anlayışını getiren bir perspektifi uluslararası hukuka kazandırma meselesidir.

The environmental rule of law requires the existence of the rules and the creation of the laws is part of State sovereignty in international law. To fulfil the first constitutive element of the environmental rule of law, recognition of the rights of nature in a soft law instrument is proposed as a means of reconciling State sovereignty with those rights. The second constitutive element of the environmental rule of law requires compliance with the rules, whereas State sovereignty leaves compliance up to States' discretion. To fulfill this constituent element of the environmental rule of law regarding compliance, environmental stewardship through appropriate supervisory techniques, such as monitoring mechanism in the UNGA Resolution regarding driftnet fishing, is suggested to reconcile State sovereignty and the rights of nature. This reconciliation process to develop the rights of nature under State sovereignty requires the involvement of non-State actors, which is not a novel idea in international environmental law. For instance, the Aarhus Convention (1998) promotes public participation, taking international environmental governance away from traditional sovereignty concerns. xvi Once the constitutive elements of the environmental rule of law are established and the rights of nature are developed under State sovereignty in international law, the functions of the environmental rule of law will be revealed. In light of the meaning of the environmental rule of law, firstly, States' discretion must be limited, whereas State sovereignty in international law grants States arbitrary power. It is found that theoretical discussions of compliance argue for case-by-case evaluations to determine the degree of compliance. The rights of nature per se are a form of insurance against non-compliance, but compliance in such circumstances would remain heavily at the discretion of States. Nevertheless, institutional settings would also affect compliance by creating pressure on States and increasing transparency under international soft law instruments. The absence of dispute settlement mechanisms does not mean that the compliance notion is pointless in a soft law instrument, as Shelton determined. To secure compliance with the consent of States, it would also be significant to examine the rights of nature within the context of sustainable development, which is a reconciliation between economic development and the protection of the environment, as stated by the ICJ in the Gabčíkovo-Nagymaros case. Clark determined that, for any argument for the protection of nature to be convincing, it would probably need to be an economic one. In this research, it is determined that the rights of nature do not require prohibition on the utilization of natural resources. The main idea behind the rights of nature is to protect the integrity of ecological systems. Thus, the rights of nature can support economic development, albeit while limiting the extent of exploitation of natural resources. The second function of the environmental rule of law, which requires the protection of the environment, must also be evaluated. State sovereignty over natural resources, which is also a part of customary international law, as stated by the ICJ, may create barriers to the rights of nature. At this stage, one must be aware that environmental problems have threatened sovereignty over natural resources. The ICJ, in the Obligations of States in Respect of Climate Change Advisory Opinion, also found that climate change affects States' permanent sovereignty over natural resources, as evidenced by scientific data. Providing that the rights of nature approach is accepted as a means of addressing climate change in international law, it also actually serves to protect States' sovereignty. To ensure environmental protection under the environmental rule of law, the rights of nature need to be recognized as superior to the exploitation of natural resources for economic development. In light of these evaluations, this research indicates that reconciling the rights of nature with State sovereignty would support moving closer to an environmental rule of law approach, even though State sovereignty remains at the core of international law. It is worth noting that rights of nature, as a legal means, would also protect State sovereignty. In the end, the notion of the rights of nature is a matter of a perspective shift from exploitation to protection.
