Murat ŞEN Jury; Assoc. Prof. Dr. Nihat BULUT Jury: Assist Prof. Dr. Veli KARAGÖZ Working population is developing fastly, parallel with the world's social order. Also the infuences of this event can be seen on the laws. For that reason the legislator, enact a new Labour Law Code and this will be serve a necessity of our country. We chose the subcontractor notion in Labour Law Code 4857. Because this subject, includes some different orders and new addments to the Labour Law Code 1475. The restrictives of this thesis are, the uses of this notion at the individual labour law, collective labour law, social security law. First of all, we explained how this relationship can forms and then what are the components of this notion. Employees, employers and the others at that relationship also effects differently. This differences are important in labour law because they are the reasons of the conclusions of the subcontractor agreements. Another important point is, there are some other notions especially in labour law and the law of obligations. Subcontractor usually dispers in that notions. At the end of the thesis as the author I have concluded that this new legislation in Labour Law Code is effected the working social order affirmative especially at the subcontractor notion. Before this the courts had to find solutions according to their judicial decisions. But with this new legislation all of the problems will depend on the laws. And the parts of the subcontracting agreements can not use the evasions of the laws. Hoping that this law about subcontractor will cause no new legal problems.
