Özet
Su, toprak ve hava kirlenmesi ~eklinde degerlendirilen yevre sorunlanna bugiin, yevrenin de klSlth ve tiikenebilir oldugu, korunmasl ve geli~tirilmesi gerektigi anlaYl~lyla yakla~I1maktadu. Bunun nedeni, tum diinya insanlanmn ortak zenginligi olan yevresel degerlerin hlzla tiikenmekte oldugunun bu donemde daha iyi anla~I1masldu. Suyun, insan ya~amlnl dogrudan dogruya etkilemesi nedeniyle hukukun sularla ilgilenmesi kaylnI1maz olmu~tur. Hukuk, biryok ihtiyaylan kar~I1amak iyin insanlara sulardan yararlanma hakklnl tanlml~tIr. Modem Su Hukukunun amaCl; su varhklan kavramtmn tamml ve tiirlerinin belirlenmesi, sular iizerindeki miilkiyet ve tasarruf yetkileri ile hakimiyet ili~kileri, sulardan yararlanma biyiminin ortaya konmasl, su planlamaslna ili~kin hiikumler koyma, su birlikleriyle ilgili duzenlemeler yapma, su sicilinin tespiti, ta~kIn kontrolu, su yonetimi, suIann bakmu ve korunmasldu. <;evreyi olu~turan unsurlar araslnda bulunan ve su hukukunun temel konulardan biri olan su kaynaklannln yonetimi hususu, yevreyle ilgili diger faktorlerin birbirini etkilemesi nedeniyle, yevre sorunlarlndan ayn olarak ele ahnmasl gUy ise de bu yah~mada bu konu ayn olarak ele ahnlp incelenmi~ ve genel olarak Ulkemizde ve Avrupa Birligi Miiktesebatlnda su yonetimi ile ilgili hukuki duzenlemeler incelenmi~, ozelde istanbul'da su yonetimi ile bu konudaki yasal diizenlemeler aynnhlanyla anlatI1maya yah~llml~tu.

The environnlental problenl defined as the pollution of ·waters, soil mld air, is no\v approached \-vith the understanding that the environinent is also liInited and nlay drain of its resources and that therefore it lnust be protected and developed. The reason for this is that people are no\v more aware of the fact that envirorunental values, the conlmonwealth of all the people of the world, are rapidly depleting. f\S \vater has a direct inlpact upon htunan life, it has become indispensable for the la\v to be involved in the subject of \vaters. La\vs entitle people to benefit froln \vater for Ineeting Inany of their needs. The purpose of the nlodern \-vaters la\v is to define the concept of \vater resources mld establish the types that exist, to describe the o\-vnership and disposition rights over \vaters, define the Inanner of benefiting frOll1 \-vaters, establish provisions pertaining to \vater planning, 111ake arrangernents v{ith the relevant \vater associations, establish the water registry, take Ineasures against floods, plan \vater Inanagelnent, and nlaintain and protect the \vaters. l\.lthough Inanageinent of "later resources constituting one of the fundalnental subjects of the \-vaters la\v, is diflicult to take up as a separate issue trOln environnlental problems due to the fact that other factors related to the environment have an impact upon each other, this subject has been separately taken up and revievved in this study together \vith the legal provisions related to \vater lnanagenlent in our country and the Ell laws, and an attenlpt has been Inade to explain the legal arrangeinents on the subject vvith special emphasis on water Inanageinent in Istanbul.
