This dissertation analyses the regulatory framework set out by the European Union (EU) regulations no 1592/2002 and 216/2008 that established European Aviation Safety Agency (EASA). Giving the historical background of the harmonisation attempts of civil aviation rules in Europe, it provides information about European Civil Aviation Conference (ECAC), the Joint Aviation Authorities (JAA) and the current regulatory structure run by EASA and the EU. Comparing the past and present, it argues that the JAA was purely a technical organisation however EASA and the EU have political concerns, and that is why they are not efficient in rulemaking, which does not match with flight safety. It also argues that the imposition of non-technical agreements such as European Common Aviation Area (ECAA) on Turkey is a big contradiction. Another argument it puts forth is that the current situation is unfair for non-EU European countries since their participation to EASA does not give them the same rights as EU member states, and hence, the pan-European system established by ECAC and the JAA is now defective.
