Arbitration has become an important dispute resolution method in the field of international commerce. It is worth saying that arbitration is a facility that allows willing parties to submit their disputes to a third party or a tribunal for a final and binding judgement. In 2001, Turkey adopted the Turkish version of the International Arbitration Law1 (hereinafter“the IAL”, Law No: 4686) in the light of recent developments in international commercial disputes. This dissertation will explain the principles of international commercial arbitration and focus on how it works. Additionally, it should be emphasized that arbitration is often based on the principle of 'party autonomy' and also it may include some intervention as a result of various arbitration theories. In the light of these theories, this dissertation will first explain international arbitration theories and later focus on the Delocalisation Theory and the Seat Theory as theoretical models of international commercial arbitration. These two major theories have influenced different states and the way they approach arbitration law and practice. The author will examine the different influences of these theories on English, French and Turkish judicial attitudes. Then, this paper will move to a detailed examination of the situation in Turkey, using precedent cases to show how Turkish judges have approached arbitration. The dissertation aims to answer two main questions; i) Are Turkish judges interfering with arbitration more than necessary and ii) Do the judges respect the principle of party autonomy? These questions will be answered by analysing past precedents in Turkey. The dissertation will conclude by bringing the author's arguments together and answering the questions posed by the author. Additionally the author will suggest some solutions which may be beneficial for improving the Turkish arbitration system in world markets. In particular, the author will answer those two questions by examining the judges` conduct of the arbitration process' and their judicial statements. Additionally, some suggestions will be made, which may improve the Turkish arbitration systems performance in world market. It is the author's hope that not only academicians but also practitioners, both international lawyers and international traders, can get a better understanding of International Commercial Arbitration in Turkey.
