The complex technical and legal issues raised by cybercrime have led States to take step to harmonize cybercrime laws and ensure procedural mechanisms to conduct successful prosecutions of cybercriminals. Although so much more needs to be done in response to cybercrime, there have been many national and international initiatives. The Council of Europe's Convention on Cybercrime is the most comprehensive response to address the most common categories of cybercrimes and provide the most common types of investigative tools used by law enforcement while establishing legal framework for international cooperation. The Convention is open to signature and ratification by any Council of Europe member states and any non-member states. Like other non-member states, including United States and Canada, Australia has also ratified the Convention. This study first analyses the nature of cybercrime and national and international approaches used for combating cybercrime and then critically examines the Convention and the Cybercrime Act 2001 enacted by Australia. As will be seen, since Australia considered the Convention as model to be followed, the Cybercrime Act was basically designed in accordance with the provisions of the Convention. After accession to the Convention, Australia became fully compatible with it. Therefore, the criticisms of both the Convention and Cybercrime Act have a lot in common. This thesis concludes that despite all criticisms from different perspective, the Convention and the accession of Australia are of vital importance in punishing cybercriminals and deterring cybercrimes. Clearly, the Convention does not represent a perfect treaty in the fight against cybercrime. However, the thesis argues that the potential risks to fundamental rights are vastly outweighed by the benefits of the Convention.
