Since the end of the Cold War, peacekeeping operations have increased in number, grown in size and changed in characteristics. Their growing importance and expanding scope have raised concerns about the international responsibility arising from such operations. The reason for this is the dual status of peacekeeping troops. As peacekeeping troops are subsidiary organs of the UN, national contingents of the troop-contributing States become agents of the Organisation during their assignment. However, they concurrently retain their status in their national service. Therefore, they become agents of two different subjects of international law. This poses difficulties in the attribution of responsibility in cases of unlawful conduct committed by peacekeeping personnel. The applicable law is unclear despite the recent ILC Draft Articles on the Responsibility of International Organisations. The reason for this is the unconformity between recent decisions of important judicial bodies and the ILC Draft Articles as different tests have been proposed. This study attempts to examine all the tests that have been proposed and to identify the one that is best fit to overcome the problems arising from the complex nature of new generation peacekeeping. With its case-by-case approach and flexibility, the effective control test seems to be more suitable to the nature of the law of international responsibility. The test provides precision in peacekeeping cases with its strong factual basis and high threshold for responsibility as what is important is not to find an imputable entity but the correct entity. It also allows room for dual responsibility which may be necessary in the complex nature of today's peacekeeping. Finally, the effective control test fulfils another of the main purposes of the law of responsibility as the international legal person who exercises effective control may be better suited to prevent unlawful conduct.
