SUMMARY Being the result of the importance attributed by the founders of the European Community to free competition which is supposed to play central role in achieving the aims of the Community,“the Institution of a system ensuring that competition in the common market is not distorted”is included in the list of activities of the Community. It would, indeed, be futile to expect benefits from establishing a common market by abolishing customs duties and charges having equivalent effect and quantitative restrictions, if the isolation of national markets could effectively be maintained by restrictive practices on the part of undertakings, or by state aid policies giving competitive advantages to the national industries. With these considerations in mind, the Competition Policy of the European Community was given place in Articles 85-94 of the Rome Treaty by the founders of the Community. Amongst them, Articles 85-90 covers the competition rules applying to undertakings. The subtantive competition rules aiming at preventing competition in the market from being distorted whereby restrictive agreements or practices or abuse of dominant positions of undertakings, are contained in Articles 85 and 86 of the Treaty establishing the European Community.As a result of the special features which give supranational chracteristic to the Community Law, these rules are directly applicable and directly effective and have primacy over national competition laws in the case of conflict between them. Article 85 of the Treaty which is the subject matter of our study, prohibits all restirictive agreements, decisions and concerted practices between undertakings, and renders such behaviours automatically void. On the other hand, the same Article also provides that, under certain conditions, the provision prohibiting restrictive agreements may be declared inapplicable in respect of agreements or categories of agreements, if their beneficial effects to the Community surpass the disadvantages caused by them. The Commission of the EC is empowered with the enforcement of competition rules by the Regulations passed by the Council of Ministers of the EC, in conformity with the principles and procedure laid down in Article 87 of the Treaty. In this regard, the Commission is conferred upon extensive powers against undertakings operating in the Community and engaging in restrictive practices, ranging from requests for information to imposing fines, and from requiring undertakings to terminate infringements, to exempting the agreements from the prohibition.The Commission, within the framework of case law developed by the Court of Justice of the EC, apply EC competition rules, even to non-EC undertakings, if the restrictive practice, in which these undertakings are engaged, produce adverse effects in the Community. Finally, as a result of the implementation of the Rule of Law principle which is one of the main fundamentals of the Community, the Decisions, taken by the Commission in the course of using its powers in relation to enforcement of the competition rules, are subject to judicial review.
