Özet
“Türk Hukukunda Destekten Yoksun Kalma Tazminatı ve Davaları”isimli çalışma ile, uygulamada özellikle trafik kazaları ile karşımıza çıkan ölümlü olaylarda, ölen kişinin desteğini yitiren yakınlarının, açmış oldukları destekten yoksun kalma tazminatı davalarında, haklarının neler olduğunun tespiti ile bu tazminat türüne ilişkin temel konuların, uyuşmazlıkların daha hızlı ve sağlıklı bir şekilde çözümlenmesi için güncel yargı kararları ışığında araştırılması amaçlanmıştır. Ayrıca, hazırlanan bu çalışmada yürürlüğe giren 6098 sayılı Türk Borçlar Kanunu ve 6100 sayılı Hukuk Muhakemeleri Kanunu'ndaki yenilikler vurgulanmıştır. Çalışma, üç ana bölümden oluşmakta olup; birinci bölümde, destekten yoksun kalma tazminatının tanımı, özellikleri, destek türlerinin neler olduğu, destekten yoksun kalma tazminatının kaynakları ve uygulamada karşılaşılan destek tiplerinden bahsedilmiştir. Çalışmanın ikinci bölümünde, destekten yoksun kalma tazminatına hak kazanmak için gerekli şartlar ile bu tazminata konu zararın tespit edilmesinde göz önünde bulundurulması gerekli hususlara ayrıntılı bir şekilde değinilmiştir. Çalışmanın son bölümünde ise, destekten yoksun kalma tazminatı davasının tarafları, dava türünde görevli ve yetkili olan mahkemeler açıklanmış, destekten yoksun kalma tazminatı davalarında zamanaşımı ve yargılama aşamasında oluşan tereddütler sebebiyle sorun olarak karşılaşılan kısmî dava, belirsiz alacak davası, ıslah, tespit davası ve faize ilişkin değerlendirmeler yapılmıştır.

It was aimed that the determination of what type of the rights belong to the relatives in lack of the support of the dead person which was sued in the cases for loss of support and the investigation the basic issues about this type of compensation, to be resolved disputes more quickly and in a healthy way in the light of current judicial decisions in practice, especially in the mortal events encountered by traffic accidents with the study named“The Compensation for Loss Of Support in Turkish Law”. Also, the innovations which was entered into force in No. 6098 Turkish Code of Obligations and No. 6100 Civil Procedure Law were highlighted in this study prepared. The study consists of three main sections; In the first section, the definition of compensation for loss of the support, its features, what kind of support that, the resources of compensation for loss of the support and support types encountered in practice are discussed. In the second part of the study, the necessary conditions to gain right for compensation for loss of the support and the necessary subjects which should be taken into account in determining the damage fort his compensation were discussed in detail. In the final part of the study, the parties in the case of compensation for loss of the support and the official and the competent courts in the type of this case were explained, the assessments were carried out about a partial case encountered as a problem, uncertain debt claims, improvement, fixing case and related interest due to the timeout in the cases of compensation for loss of the support and the hesitations to be formed at the trial stage.
