Özet
ÖZET Taşınmaz satış vaadi sözleşmesi, günümüzde sıklıkla başvurulan bir sözleşme türüdür. Türk hukuk sistemimizde de önemli bir yeri vardır. Bu çalışmamızda taşınmaz satış vaadi sözleşmesinin tapudaki uzun işlemlerden olmayışı, getirdiği kolaylık ve toplumun ihtiyaçlarına kolayca cevap vermesi üzerinde durulmuştur. Ayrıca, inşaat sektörünün ülkemizde hızlı gelişimiyle beraber, taşınmaz satış vaadi sözleşmeleri kat karşılığı inşaat yapım sözleşmeleriyle de iç içe girmiştir. Bunun neticesinde, taşınmaz satış vaadi sözleşmesi hukukumuzda da önemli bir yer teşkil etmiştir. Çalışmamızda kısaca özetleyecek olursak, taşınmaz satış vaadi sözleşmesinin tanımı, konusu, şekli, mevzuatta düzenlenişi, önemi ve diğer sözleşmelerden farkı ile hukuki niteliği, sözleşmesinin kuruluşu, tarafları, unsurları, şekle uymamanın sonuçları, sözleşmenin ifası ile tarafların hak ve yükümlülükleri, borcun ifa edilmemesi, sözleşmenin feshi, sözleşmeden dönme, yüklenicinin temlikinin sonuçları, satış vaadine konu taşınmaz üzerinde ipotek haciz ve tedbir olması ile görevli ve yetkili mahkemenin tespiti konu edilmiştir. Amacımız, taşınmaz satış vaadi sözleşmesinden kaynaklanan uyuşmazlıkları farklı bir bakış açısıyla incelenecektir.

PRELIMINARY CONTRACT FOR SALE FOR UNMOVABLES The immovable sale promise contract is a type of contract which is frequently applied today. There is also an important place in our Turkish legal system. In this study, it was emphasized that the immovable sales promise contract is not from long transactions in the crate, it provides convenience and easily responds to the needs of the society. In addition, with the rapid development of the construction sector in our country, the promises of real estate sales have been intertwined with construction contracts for floors. As a result, the real estate sales promise agreement has also become an important place in our law. We will summarize our work briefly, the description of the real estate sales promise agreement, the nature of the difference between legal and legislation, the difference between legal and other contracts and the legal nature of the contract, the constitution of the contract, the elements of the contract, the consequences of not conforming to the contract, the rights and obligations of the parties, The dispute arising out of the promissory contract, the return of the contract, the consequences of the assignment of the contractor, the assignment of the mortgage on the property subject to sale promise and the determination of the competent and competent court have been discussed.
