Özet

Konut ve çatılı işyeri kira sözleşmelerinde, kiracının, ekonomik açıdan veya pazarlık gücü bakımından zayıf konumda bulunduğu varsayılmaktadır. Bu sebeple, söz konusu kira ilişkilerinde, kiracının korunması esası benimsenmiştir. Kanun koyucu, kiracının korunması düşüncesi ile,“kira bedeli”hususunda, sözleşme serbestîsini önemli ölçüde sınırlandıran özel hükümler sevk etmiştir. Ancak, kira bedeline ilişkin bu sınırlamalar, kiraya verenin mülkiyet hakkına müdahale teşkil etmektedir. O hâlde, bir yandan kiracı yüksek kira bedeline karşı korunurken diğer yandan kiraya verene piyasa gelişimine uygun bir kira bedeli sağlanmalıdır. Toplumun önemli bir kesimini teşkil eden kiracı ve kiraya verenin, kira bedeli hususundaki menfaat çatışması, uyuşmazlıkları beraberinde getirmektedir. Konut ve çatılı işyeri kira sözleşmelerinden kaynaklanan uyuşmazlıklarda yargıyı en çok meşgul eden konulardan biri kuşkusuz“kira bedeli”dir. Fakat, konunun önemine rağmen, konut ve çatılı işyeri kira sözleşmelerinde kira bedeli hususunda ülkemizde, doktora düzeyinde akademik bir çalışma bugüne kadar gerçekleştirilmemiştir. Bu çalışmada, konu ile ilgili ulusal ve uluslararası düzenlemeler, bilimsel eserler ve yargı kararları incelenerek, detaylı bir eser oluşturulması ve Türk hukukuna bu şekilde katkıda bulunulması amaçlanmıştır. Nihayet, ileride konu ile ilgili yapılacak kanun değişikliğinde kanun koyucuya yol göstermek de çalışmanın amaçları arasındadır. Bu sebeple mukayeseli hukuktaki durum özellikle ayrıntılı bir şekilde ortaya konulmuştur.

It is supposed that the tenant is in a weaker position, in terms of economic and bargaining power, in lease contracts of residential premises and roofed workplaces. Hence, the principle of tenant protection has been adopted in the said rental relations. The lawmaker has impelled special provisions restricting the leasing liberty considerably on the issue of“rent”for the purpose of protecting the tenant. However, these restrictions about rent constitute intervention to the ownership right of the owner. Therefore, whereas the tenant is protected against high rent, rent must be ensured according to the market development of the owner. The conflict of interest about the issue of rent between the tenant and owner, making up a significant section of society, implies disputes. One of the issues engrossing the judicial authorities in disputes originating from lease contracts of residential premises and roofed workplaces is“rent”absolutely. However, despite the significance of the matter, there is no academic study conducted concerning rent in lease contracts of residential premises and roofed workplaces at the level of doctorate to date in Turkey. The aim of this study is preparing a detailed work by way of analyzing national and international regulations, scientific works and adjudications, and making contribution to Turkish Law. In addition, providing an insight for the lawmaker with respect to the future law amendments is another aim of this study. In this regard, the situation in comparative law is presented particularly in detail.
