Özet
Tezimizin konusu zihinsel engellilerde ehliyet olduğu için ehliyet kavramını genişçe ele alıp; ehliyetin tanımı, bölümleri, ehliyet açısından insan hayatının dönemleri, ehliyeti daraltan, ortadan kaldıran sebepler ve genel olarak ehliyete etki eden durumları ayrıntıları ile yazdık. Araştırmamızın sonucunda orta ve ağır zihinsel engellilerde temyiz gücünün olmadığını, ancak hafif derece zihinsel engellilerde temyiz gücünün olduğunu gördük. Dolayısıyla vücûb ve eda ehliyeti açısından ayrıca velayet, vasiyet, ceza ehliyeti, nikâh, talak, mali duruma etki eden sebepler ve ibadetler hususunda bu iki grubu farklı değerlendirdik.Orta ve ağır derecedeki zihinsel engellilerin temyiz yani ayırt etme güçleri olmadığı için cünûn kapsamında, ancak hafif derecedeki zihinsel engellileri buluğ çağına erseler bile o akli yetiye sahip olmadıkları için mümeyyiz çocuk kapsamında değerlendirilmesini uygun gördük.

Since the subject of our thesis is the driving license of the mentally disabled, it covers the concept of driving license; we have written in detail the definition of the driver's license, the chapters, periods of human life in terms of driver's license, the reasons that narrow the driver's license and eliminate it and the situations affecting the driver's license in general. As a result of our research, we found that there is no appeals power in the moderate and severe mentally disabled, but there is appeals power in the mildly mentally disabled. Therefore, we also evaluated these two groups differently in terms of custody, testament, criminal license, marriage, talak, financial situation and worship in terms of body and eda capacity.however, even if they reach the age of mentally handicapped people, we deem it appropriate to be evaluated within the scope of the possible child because they do not have the mental ability. https://cevirsozluk.com/
