Özet
Bu tez, ünlü Alman filozof Karl Jaspers'in suç kavramı üzerine eleştirel bir yaklaşım getirmeyi amaçlamaktadır. Jaspers'in“ahlaki ve metafizik suç”ayrımlarında dile getirdiği suç yaklaşımı, günümüzde ancak belli bir hukuk sisteminde anlamı olduğuna inanma eğiliminde olduğumuz suç algılayışına zarar veren bir yaklaşım olarak görülebilir mi? İşte bu tez, bu soruya cevap verme doğrultusunda, Birinci Bölüm'de, bir bütün olarak Jaspers'in felsefe anlayışı merkezinde onun“varlık”,“insan”ve“varoluş”kavramlarını açıklamaktadır. İkinci Bölüm'de, Jaspers'te“varoluş”,“özgürlük”ve“iletişim”kavramlarıyla ilişkisinde suç kavramı ön plana çıkarılmaktadır. Üçüncü Bölüm'de ise, Jaspers'in suç kavramına dair yaptığı ayrımlardan hareketle, ahlaki ve metafizik suç ile Jaspers'in neyi dile getirmeyi istediği gösterilmeye çalışılmıştır. Tezin Sonuç Bölümü'nde, Jaspers'in ahlaki ve metafizik suç anlayışının, hukuk alanında suçun algılanışı üzerinde olumsuz olabilecek etkileri vurgulanmıştır.

This dissertation aims to make a critical approach to the concept of the guilt of the famous German philosopher Karl Jaspers. The concept of guilt that we believe has a meaning in a certain judicial system. Can the guilt approach described by Jaspers in the distinction of“moral and metaphysical guilt”be considered as a harmful approach? This dissertation aims to answer this question. In the first chapter, his terms of“being”,“human”and“existence”are explained with the Jaspers philosophy as a whole. In the second chapter, the concept of guilt is emphasized in the relationship of Jaspers with“existence”,“freedom”and“communication”. In the third chapter, Jaspers' distinctions about the concept of guilt are evaluated and based on these distinctions, the moral and metaphysical guilt and what Jaspers means are explained. In the conclusion of the dissertation, it is emphasized that the moral and metaphysical guilt understanding of Jaspers can have negative effects on the perception of guilt in the field of law.
