Özet
Bu yüksek lisans tezinin yapılmasındaki amaç; kişi hürriyeti ve güvenliği hakkını incelemek ve bu hak ile ilgili Anayasa Mahkemesine yapılan bireysel başvurularda tespit edilen ihlâlleri değerlendirmektir. Birinci bölümde, kişi özgürlüğü ve güvenliği hakkının, dünyada ve ülkemizdeki tarihsel gelişiminden bahsedilecektir. İkinci bölümde kişi, özgürlük ve güvenlik kavramları ayrı ayrı tanımlanarak, kişi özgürlüğü ve güvenliği hakkın kavramı ve kapsamı açıklanacaktır. Üçüncü bölümde, hakkın kısıtlanması ve hakkı kısıtlanan kişinin haklarından bahsedilecektir. Dördüncü bölümde ise kişi özgürlüğü ve güvenliği hakkı ile ilgili Anayasa Mahkemesi tarafından ihlâl kararı verilmiş olan bazı bireysel başvuru kararları incelenerek çalışma sonuca bağlanacaktır.

The purpose of this master thesis is to examine the right to individual freedom and security and to evaluate the violations identified in individual applications to the Constitutional Court. In the first chapter, the historical development of the right to freedom and security of the person in the world and in our country will be mentioned. In the second part, the concepts of person, freedom and security will be defined separately and the concept and scope of the right to freedom of person and security will be explained. In the third chapter, the rights of the person who has been restricted and the rights of the person who is restricted will be mentioned. In the fourth chapter, some individual application decisions which were decided by the Constitutional Court regarding the right to freedom and security of the person will be examined and the study will be concluded.
