Özet
Tez konusu olarak belirlediğimiz“Uyuşturucu veya Uyarıcı Madde İmal ve Ticareti Suçu”, Türk Ceza Kanunu'nda“Kamunun Sağlığına Karşı Suçlar”başlığı altında düzenlenmiştir. TCK m. 188/1'de: Uyuşturucu veya uyarıcı maddeleri ruhsatsız veya ruhsata aykırı olarak imal, ithal veya ihraç etmek suç olarak düzenlenmişken; m. 188/3'te ise; Uyuşturucu veya uyarıcı maddeleri ruhsatsız veya ruhsata aykırı olarak ülke içinde satmak, satışa arz etmek, başkalarına vermek, sevk etmek, nakletmek, depolamak, satın almak, kabul etmek veya bulundurmak suç olarak öngörülmüştür. Bununla birlikte m.188/2'de; ithal ve ihraç eylemleri açısından farklı ülkelerde hükmolunan ve infaz edilen cezaların Türkiye'de verilen aynı eylemlere ilişkin ceza mahkumiyetlerinden mahsup edileceği, m.188/4,5'te suçun nitelikli halleri düzenlenmiştir. Ayrıca TCK m. 188/6'da; üretimi resmi makamların iznine veya satışı yetkili tabip tarafından düzenlenen reçeteye bağlı olan ve uyuşturucu veya uyarıcı madde etkisi doğuran her türlü madde açısından da yukarıdaki fıkralar hükümleri uygulanır ve m.188/7'de ise uyuşturucu veya uyarıcı etki doğurmamakla birlikte, uyuşturucu veya uyarıcı madde üretiminde kullanılan ve ithal veya imali resmi makamların iznine bağlı olan maddeyi ülkeye ithal eden, imal eden, satan, satın alan, sevk eden, nakleden, depolayan veya ihraç eden kişi, sekiz yıldan az olmamak üzere hapis ve bin günden yirmibin güne kadar adlî para cezası ile cezalandırılır. Son olarak m.188/8'de ise; bu maddede tanımlanan suçların tabip, diş tabibi, eczacı, kimyager, veteriner, sağlık memuru, laborant, ebe, hemşire, diş teknisyeni, hastabakıcı, sağlık hizmeti veren, kimyacılıkla veya ecza ticareti ile iştigal eden kişi tarafından işlenmesi nitelikli hal olarak öngörülmüştür.

The“Crime of Drugs or Stimulants Production and Trade”that we have determined as the subject of the thesis is regulated under the title of“ Crimes Against Public Health ”in the Turkish Penal Code. When manufacturing, importing or exporting drugs or stimulants unlicensed or illegal contrary to the law regulated in the article 188/1 of TPC; it is foreseen as a crime to sell, sell, sell, store, buy, accept, or store drugs or stimulants unlicensed or unlawful in the country in the article 188/3. However in the article 188/2; import and export actions shall be imposed in different countries in terms of enforcement and the criminal penalties for the same action will be deducted from the sentence given in Turkey, qualified forms of the crime is organized in the article 188/4,5. It is also stated in the article 188/6 of TPC that the provisions of above subsections are applied in every aspect for all kinds of drugs with relieving or exciting affect, of which the production is subject to permission of the competent authorities and the sale is realized under prescription issued by a physician and in the article 188/7 of TPC that any person who engages in import, sale, purchase, transport, storage or export of any product of which the import and production is subject to permission of the official authorities with the purpose of using this in production of addictive or relieving/exciting drugs is punished with imprisonment not less than four years and also imposed punitive fine up to twenty thousand days. Finally, it is stated in the article 188/8 of TPC that in case of commission of the offenses mentioned in this article by a physician, dentist, pharmacist, chemist, veterinary, health personnel, laboratory technician, midwife, nurse, dentistry technician, nurse, health personnel or any other person dealing in chemistry or pharmacy; the punishment to be imposed is increased by one half
