Özet

II ÖZET Bu tezde, insan haklan ile temel hak ve hürriyetlerin uygulamaya geçirilmesinde çok önemli görevleri yerine getiren“adlî polis”incelenmiştir. Üç bölümden oluşan çalışmanın ilk bölümünde, adlî polisin tanımına ve tarihçesine değinilmiştir. Mukayeseli hukukta polisin organizasyonuna yer verilirken özellikle adlî polisin genel zabıta içerisindeki durumu belirtilmeye çalışılmıştır. Zabıtanın bütünlüğünü savunanların görüşleri ile adlî polisin genel zabıtadan ayrılmasını savunanların görüşlerine yer verilmiştir. Müesseseye hâkim olan ilkeler belirtilmiştir. İkinci bölümde, adlî polisin görevlerine (daha doğrusu zabıtanın adlî görevlerine) ve savcılık ile zabıta arasındaki ilişkilere değinilmiştir. Zabıtanın adlî görevlerini hukuka aykırı yapmasının sonuçları ile değişik zabıta güçleri arasındaki koordinasyon konusuna yer verilmiştir. Üçüncü bölümde, bazı Batılı demokratik ülkelerin ve özellikle de genel zabıtadan ayrı ve savcılar tarafından yönetilen neredeyse dünyadaki tek adlî polis modelini oluşturan“Belçika Adlî Polis Teşkilatı”örnek alınarak bir“Adlî Polis Teşkilatı”modeli önerilmiştir. Bu bölümde, adlî polisin merkez ve yerel organizasyonunun nasıl olması gerektiğine, adlî polisin personeline ve personelin eğitimi konusuna değinilmiştir. Sonuç bölümünde ise bu tezde ortaya çıkan sonuçlara ve önerilere yer verilerek çalışma tamamlanmıştır.

III ABSTRACT In that thesis, the criminal police, who have such importent duties as carrying out the humen and main rights and freedom, is examined. The thesis contains three main sections. In the first part, the historical background and the meaning of criminal police has been explained. The police organisation is examined in the comperative law, by the way it is tried to explain the position of criminal police in the general constabulary organisation. The ideas which defend the unity of the police and which defend the seperation the criminal police from the general constabulary have taken parts in the first section of the thesis. And the principles are examined. In the second section, the duties of criminal police - or, in other words the judiciary duties of constabulary - and the relationship between the law and constabulary organisation are explained. Here, the results of being done the judiciary duties in any incongruous way to law by the police and the coordination between the different branches of constabulary organisation are mentioned. In the third section a Criminal Police Organisation is proposed. In this proposal some of the Western Democratic Countries and especially Belgium Criminal Police Organisation which is seperated from the general constabulary and is managed by the prosecutors and is almost the only Criminal Police Organisation in the world have been taken as examples. In this section it is mentioned that how a main and the local organisations of criminal police must be and also the stuff of criminal police organisation and their education is explained. At the end, the thesis is finished by the proposals and the results which occur in it.
