Miscarriage of justice is deemed to be an important criminal justice policy issue in the United States. The most prominent and enduring cause of miscarriages of justice that has been exist throughout American history, is accepted to be prejudice; exclusively in terms of race. The historical and current scope of wrongful convictions in the United States caused by erroneous judicial decisions as a result of racial prejudice, will be addressed to fully understand how the classic form of racial prejudice against blacks has faded away, bringing up the recent form of racial prejudice against Muslim Americans. The key legislations and pre-trial procedures will be assessed in order to demonstrate how these convey racial prejudice and how it results in errors in justice. This writing's key purpose is to discover; why an individual that belongs to a certain racial community such as Blacks and Muslim Arabs, is more likely to be perceived as a suspect within the pretrial phase of the criminal justice system of the United States. By analyzing the root reasons behind such prejudicial assumptions based on race, it might be possible to avoid such prejudicial decisions; thus preventing the possibilities of future wrongful convictions and errors in the criminal justice system of the United States. Various case studies and social psychological studies will be reviewed in order to obtain a better understanding of how federal and state courts dealt with cases of wrongful convictions as a result of racial prejudice on part of the police, throughout American history. Furthermore, defendant rights in criminal proceedings will be explored as well as other reforms and measures that have been implemented to prevent or reduce the risks of error within the criminal justice system of the United States.
