Özet
İşçi ile işveren arasında tesis edilen iş ilişkisi ile kurulan iş sözleşmesi tam iki tarafa borç yükleyen bir sözleşmedir. İşçinin iş görme borcuna karşılık, işverence işçiye ücret ödenir ve ücret işverenin asli borcudur. Ücretin ödenmemesi ya da eksik ödenmesi işçiyi ve ailesini zor durumda bırakabilecektir. Zira iş sözleşmesinin asli unsurlarından olan ücret, kural olarak işçinin ve ailesinin tek geçim vasıtasıdır. Bu nedenle de hem uluslararası hukukta hem de ulusal hukukta ücreti özel olarak korumaya yönelik pek çok düzenlemeye yer verilmiştir. Nitekim işçinin ücreti Türk Hukukunda başta Anayasa olmak üzere İş Kanunu ve diğer kanunlardaki düzenlemelerle, ücret bir yandan işverenin işlemlerine karşı diğer yandan da işçinin bizzat kendi işlemlerine ve üçüncü kişi işlemlerine karşı korunmuştur. Tezimizde, genel olarak ücret kavramından bahsedildikten sonra esas olarak ücretin, Türk Hukukunda ücretin geç ya da gereği gibi ödenmemesi ya da ücrette indirim yapılması veya işçiden olan alacağı sebebiyle takas edilmesi gibi işverenin işlemleri ile, işçinin kendi işlemlerine ve üçüncü kişi işlemlerine karşı korunmasına dair düzenlemeler doktrinsel tartışmalar ve yargı kararları çerçevesinde incelenecek, konumuz ile sınırlı kalacak düzeyde uluslararası hukuktaki düzenlemelerine de ayrıca yer verilecektir. Son olarak tezimizde, ücretin korunmasına yönelik hükümlere aykırılık halinde öngörülen yaptırımlar üzerinde de kısaca durulacaktır.

The employment contract established with the employment relationship established between the employee and the employer is a contract that imposes debts on both parties. In return for the employee's debt to work, the employer pays the employee a wage and the wage is the employer's primary debt. Not paying the wage or paying it incompletely may put the worker and his family in a difficult situation. Because the wage, which is one of the essential elements of the employment contract, is the only means of subsistence of the worker and his family as a rule. For this reason, many regulations have been included in both international law and national law to specifically protect wages. As a matter of fact, the wage of the worker is protected against the actions of the employer, on the one hand, and against the actions of the worker himself and third parties, on the other hand, with the regulations in the Turkish Law, notably the Constitution, the Labor Law and other laws. In our thesis, after mentioning the concept of wage in general, the regulations regarding the protection of the employee against his own transactions and third party transactions, such as the employer's actions such as late or improper payment of the wage in Turkish Law or a reduction in the wage or barter due to his receivable from the employee, are doctrinal. will be examined within the framework of discussions and judicial decisions, and its regulations in international law will also be included, which will be limited to our subject. Finally, in our thesis, we will briefly focus on the sanctions foreseen in case of violation of the provisions on the protection of wages.
