Dispute Boards ('DBs') have become prevalent as a means of dispute avoidance and settlement in plant and major infrastructure projects in the last few decades. Distinctive characteristics of DBs are that they are established permanently from the beginning of the project until its substantial completion, that they render either recommendations or initially binding decisions depending on the type of DBs based on summary proceedings, and that they comprise of independent and impartial professionals including lawyers. Usage of Dispute Adjudication Board invented by FIDIC 1999 conditions of contracts has gradually started to become an indispensable primary way of dispute resolution within the International Construction Industry in a widespread manner. As a result of failure in securing enforcement of binding decisions in FIDIC 1999, tribunals and courts have favoured different approaches. After much confusion and loss of rights FIDIC 1999 created, such failure has been eliminated by the advent of FIDIC 2017 conditions of contracts
