Today's discussions on Islam and the place of religion often place much focus on the sharī'a as Islamic law. In Iran and Saudi Arabia, many who are politically involved work have demanded that the sharī'a be applied to all areas of life. However, what the sharī'a says versus what God has prescribed for the believers can sometimes be difficult to distinguish in certain legal areas. In light of this difficulty, it becomes clear that various dynamics of social life have played an important role in shaping the history of the law. This history gives mention to key aspects including: the formulation of the law over time, those involved in this formulation, its theoretical basis, and its numerous methods, principles, and elements. The topic of this essay directly relates to the history of this law in that it seeks to examine how the sharī'a has been enacted and practiced, both historically and in modern times, in Saudi Arabia and Iran. The examination of their legal systems will be discussed over three chapters and several subsections. The first and second chapters of this thesis focus on the evolution of the law in Iran and Saudi Arabia, respectively. Furthermore, these chapters will give attention to the fundamental sources of the law as well as its varied relationship with political authorities and its legal education systems. The purpose of these sections is to explain the formation of sharī'a systems using knowledge that has been generated within the field. Understanding the principal aspects, chronological alterations, and main elements of the legal systems in Iran and Saudi Arabia allows for a broad understanding of how sharī'a has been adopted in these countries. The final chapter draws on a brief framework for how these legal systems arrive at personal rulings and presents some illustrative examples of sharī'a rules in the field of family law, with special focus on the age of consent for marriage Iran and Saudi Arabia. Ultimately, the primary aim of this research is to reveal how the implementation of differs in these two countries and to what extent the differences can be attributed to the sharī'a or local culture and history. It would appear that in certain areas, particularly the age for marital consent, culture is more important than fiqh texts and this is perhaps because classical texts are routinely ignored in favour of culture or custom.
