düzenleme uyarınca kapatılmalarına sebebiyet verecek uygulamaların önüne geçilmeye çalışılmaktadır. 216SYNOPSIS The present study where“The Freedom for Aliens of Education and Training”is elaborated within the context of Turkish Aliens Law, consists of two parts following an“introduction”which conveys general knowledge and observations with regard to categorizing and confining the rights and freedoms of aliens. Since education and training can not be seperated from the concepts of“pupil”,“theacher”and“educational institution”, the right of aliens to education and training has been structurized in three diverse aspects, that is“right to education and freedom of education”,“freedom of training”and“freedom of educational institutions”. All those categorizes of freedom is considered in the light of the provision at article 16 of the Constitution, providing“fundemental rights and freedoms, may be restricted for the aliens by law in accodance with international law”. Part One deals with“the right to education and freedom of education”and“right to teaching”. For right to education and freedom of education have a broad scope, only the right to access to educational institutions and right to education in one's own culture and language are held in this thesis. Accodingly, right to education and freedom of education have been considered in the light of domestic and international regulations, at first; then the restrictions for the aliens regarding their access to educational institutions are set forth.“Freedom of Theaching for Aliens”is held in Part One, Chapter Two. The right of aliens to teach at Turkey forms an exception of the rule prohibiting or restricting the aliens to work. Aliens can assume duty at Turkish private schools, foreign private schools, consular schools and institutions of higher education.“Freedom of Educational Institutions for Aliens”is held in part Two. In this part, firstly freedom of educational institutions for aliens is elaborated in Ottoman Empire; then related provisions of The Treaty of Lousanne is set forth. Today, there are 17 foreign schools which have been established in the period of Ottoman Empire, their existence recognized by the Treaty of Lousanne, these institutions have been maintaining in accordance with the principle of“wested rights”. Apart from these schools, according to the provisions of Law of Private Educational Institutions, aliens can establish“international schools”where aliens can accees only in Turkey. According to the Law 4306 (dated 1997) preliminary education will be elevated to eight years. This regulation provides the terminating of secondary levels of all schools.
