Restorative Justice as a whole, and in particular, victim-offender mediation and restorative conferencing are the most significant subjects of the Alternative Dispute Resolution realm in the criminal justice context, and, in recent decades, it has become an increasingly popular alternative to the conventional criminal justice system, whose main response to a crime is often punishment of the criminal. Restorative justice, however, puts more emphasis on victim needs and focuses predominantly on the reintegrative and reparative solutions for victims, offenders and the involved community, instead of satisfying abstract legal principles or punishing the offender. Therefore, it offers a tempting choice for those dissatisfied with the retributive, adversarial and impersonal focus of the existing criminal justice system. Research findings and studies have frequently demonstrated that restorative justice generates more successful outcomes than the traditional criminal justice system in terms of reducing offender recidivism and satisfying victims. The aim of this thesis is to discuss the underlying factors of these achievements and the role of empathy and interaction within them. The results are encouraging for jurisdictions that experiment with this approach and seek a more active role for victims of crimes within the judicial processes. In terms of reducing recidivism, fairness of the restorative justice processes, whose purpose is reintegration of the offender into the community instead of using punishment as the main instrument, and emotions arising from the interaction and empathy between the victim and the offender, such as shame, remorse and compassion, seem to be influential on the offender's future behaviour. As to victim satisfaction, taking part and playing a more active role in the process and encountering the offender is one of the elements in satisfying victims. Additionally, both financial and emotional reparation opportunities and fair and respectful treatment also have positive effects on victims. Indeed, interaction and empathy between the parties are, again, amongst the factors underlying victim satisfaction as they have the potential to make the offender comprehend the victim's suffering, accept the responsibility and make amends for it
