154 ABSTRACT The concept of consumer finance in Turkey has been first introduced by T.C.Ziraat Bankasy during 1950's as agricultural equipment finance. However, the major development in consumer credit dates back to the years of the structurel change in the Turkish Financial System that is late 1980's. Consumer Credits put into practise in 1989 with the leadership of few sizable bank and become a significant credit alternative for the commercial banks. Thereafter, with the revision of the“Regulation on Loan Business Finance”in 1994, this alternative credit for the banks has become the instrument of a new sector also,“Consumer Finance Sector”Regulations stimulated the sizeable conglomerates to establish consumer finance companies. The establishment of consumer finance companies has given a rise to a new system in the credit market and the development trend of consumer financing has contributed to the improvement of the financial markets. Although most of the consumer finance activities in Turkey are carried out by banks, it is well known that the new system appearing with consumer finance companies has increased the activity in the Turkish Financial Markets by inducing competition. The decree regulating the establishment of consumer finance companies was enacted in mid 1994. Following the enactment of this decree, the first consumer finance company, Koç Tüketici Finansmany A.t>. (Koç Finans), was established in January 1 995 with the permission of Undersecreteriat of Treasury. Although finance companies have been in existence for a short period of time in Turkey, their operations have expanded and become a very important feature in the Turkish Financial Market. The most important factor contributing to this rapid growth has been consumer demand. High and continuous demand in the economy has provided an appropriate environment for profitable operations of consumer finance companies and attracted companies to the consumer finance sector..^JTS^::'^..,..,“'- \.3. J Z'. ?? ?.? ”'. \ ^ '>'i ! \V -s ; f v° -V- - ???$ ' '-\, t- ' r' - '*,-.,f155 The first consumer finance company was Koç Finans was established by Koç Group, the biggest business conglomerate in Turkey, they have achieved 1 million contracts within 2.5 years period, as of June 1998. The system, that was initiated by Koç Finans, facilities finance services to customers at the point of sale through its widespread dealership net all over the country, which has in turn led to the emergence of a new financial sector, already consisting of 8 companies. Furthermore, this system has contributed to the establishment of a far more reliable financial service to the customers at lower-cost, while also stimulating competition and institutionalization within the Turkish Financial Markets. The most significant charecteristic of consumer finance activities is extending loans to the consumer at the point of sale by the authentication of the related consumer finance company. The credits granted by consumer finance sector are paid to dealers' account on behalf of the customer, while repayment is made to the consumer finance company by the customer. Although the establishment of new consumer finance companies has contributed to the development of the sector, it needs to develop more order to be able to meet the demand for the activity in the consumer finance sector. The structure of Turkish Financial System is based on the development of the banks. However, with the development of the economy and the financial sector, new financial institutions and instrument have appeared and this development has necessitated new legal regulations for the finance companies. The consumer finance companies are operating in financial markets“directly”, by granting credits like banks. On the other hand they raise funds from the financial markets through the banks, that is“indirectly”. In my thesis, I broadly discussed consumer finance companies by looking at their applications abroad and Turkey. In the first part, in order to understand the necessity of consumer finance companies, the developments of consumer credits in Turkey and outside the Turkey have been investigated. Then, application of consumer financing in different countries and J Community Countries have been studied.156 In the second part of thesis, the regulations on consumer finance companies and the position of this companies against the tax regulations have been analysed. Accounting and Auditing Principles of this companies have been investigated under the light of accounting and auditing system in Turkey. In the third section of my thesis, in order to understand organization and working principles of these companies, Koç Finans (the first consumer finance company in Turkey), Fiat Bank in Deutschland and GE Capital in Edinburgh case have been studied. In the final section, The structural properties of consumer finance companies have been evaluated under the light of previous explanations and some proposals have been made for such companies to work effectively in the financial markets. 3 8* 3» -f f i Is*/ \*f^~ * "-S.
