Özet
Bu araştırma, özellikle tahkim hukukunu, hakem kararlarının tanınması ve tenfizini ve 1958 tarihli New York Sözleşmesi uyarınca tenfizin red sebeplerini incelemektedir. Çalışmada, uluslararası tahkim kararlarının tanınması ve tenfizine ilişkin iki farklı hukuk sistemi; uzun bir tahkim geleneğine sahip teamül hukuku sistemine sahip İngiliz hukuku ile bir Kıta Avrupa hukuk sistemi olan Türk hukukunun yaklaşımlarını mukayeseli incelenmektedir.

Arbitration for the resolution of commercial disputes has become significant because of the impact of globalization on international trade over the last decades. International instruments, particularly the New York Convention of 1958, have played a vital role in the advancement of international arbitration. The New York Convention, which currently has 144 States parties from around the world, provides a simple and efficient method of recognition and enforcement system for arbitral awards. This thesis compares the approach of two different legal systems for the recognition and enforcement of international arbitration awards, English law (a common law system) and Turkish law (a civil law system). It also discusses the lack of harmonization arising from a variety of diverse approaches, interpretation and application by the States parties to the New York Convention which has been dubbed the“most effective instance of international legislation in the entire history of commercial law”(Mustill 1989: 43). Furthermore, the thesis gives an account of the discussions for the improvement of the international enforcement regime for arbitration awards, and assesses whether the possible obstacles could be resolved within the system provided by the New York Convention. In so doing the thesis identifies four key possible obstacles that may require further resolution: 1. State immunity may be used as a ground for refusal for the enforcement of arbitral awards even though Article V of the Convention does not refer to such a ground among those limited circumstances whereby refusal may ensue. 2. Article III sets out the procedure for enforcement which depends on national rules which may vary in different States parties. 3. The compatibility of the formal requirement of a written arbitration agreement in Article II, with contemporary electronic commerce and trade practices. 4. The enforceability of an international arbitral award by national courts that has been annulled in the place of arbitration in light of Article V(1)(e) and the possibility of having conflicting judgments in different signatory states in the same dispute.
