Özet
Posta hizmetlerinin bir haberleşme hizmetinden ziyade çeşitli kurum ve kişiler arası paket teslimatına dönüşüm süreci, tüm dünyada ve ülkemizde hem kamu otoritesi olarak var olan posta işletmelerinin yapısını hem de paket teslimatı hizmetinin tüm süreçlerini doğrudan etkilemiştir. Kimi ülkelerde tek seferde kimi ülkelerde ise aşamalı olarak kalkan posta tekeli, posta sektörünün rekabete açılması ve artan paket teslimatları, sektörü yeni hukuki ve operasyonel düzenlemelere mecbur bırakmıştır. Posta kavramı artık daha az kullanılmakla birlikte posta ile ifade edilen paketlerin teslimatı gündelik hayatın neredeyse herkes için ayrılmaz bir parçası haline gelmiştir. Artan bu hacim, posta sektörünün hukuki ve ekonomik yönüne dikkatleri yoğunlaştırmıştır. Sektördeki düzenlemeler ülkemizde Posta ve Telgraf Teşkilatı'nın anonim şirket haline gelmesi, sektörün posta tekeli haricinde rekabete açılması ve pek çok yasal yeni düzenlemeler şeklinde gözlemlenmiştir. Sektörün dinamik yapısı gelişmelerin devamına neden olmaktadır. Ancak kaydedilen gelişmeler ile sektörün bugün geldiği noktada yaşanan problemler ve çözüm önerileri araştırılmış, sektörde denetimlerin artırılması ve bu denetimlerin şikayete tabi olmaması gerektiği sonucuna varılmıştır. Bunun için de, sektördeki işleyiş ve rekabetten sorumlu üst otorite Bilgi Teknolojileri ve İletişim Kurumu'ndan sektörü daha yakın bir şekilde takip etmesi beklenilmektedir. Sektörden sorumuluğu ve kendisi de yeni sayılabilecek bir kurum olarak Bilgi Teknolojileri ve İletişim Kurumu, teknolojik ve insan kaynağı yapısı ile gelişmiş bir kurum olarak nitelendirilmekte ancak sektörün dinamik yapısına ayak uydurması için alması gereken yol bulunmaktadır. Bunu da sektör paydaşları, evrensel hizmet yükümlüsü Posta ve Telgraf Teşkilatı Anonim Şirketi ve sektörün sivil toplum organizsayonu Türkiye Kargo, Kurye ve Lojistik İşletmecileri Derneği ile etkileşimli olarak yapması önerilmektedir. Sektörün dinamik yapısı ve büyüyen hacmi, daha çok oyuncuyu barındırabilecek potansiyele sahip görünmektedir. Ancak bu büyüme haksız rekabetin olmadığı bir piyasa yapısıyla mümkün olacaktır.

The transformation process of postal services into package delivery between various institutions and individuals rather than a communication service has directly affected both the structure of the posta enterprises that exist as public authorities and all the processes of the package delivery service all over the world and in our country. The postal monopoly, which was abolished in some countries at once and in some countries gradually, the opening of the postal sector to competition and increasing package deliveries forced the sector to new legal and operational regulations. Although the concept of mail is less used now, the delivery of packages expressed by mail has become an inseparable part of everyday life for almost everyone. This increasing volume has focused attention on the legal and economic aspects of the postal sector. The regulations in the sector have been observed in our country in the form of Postal and Telegraph Corporation becoming a joint stock company, opening the sector to competition except for the postal monopoly, and many new legal regulations. The dynamic structure of the sector causes the continuation of the developments. However, with the developments experienced, the problems and solution proposals experienced at the point where the sector has reached today were investigated and it was concluded that the inspections in the sector should be increased and these inspections should be done before complaining. For this reason, it is expected that Information and Communication Technologies Authority, the authority responsible for the operation and competition in the sector, will follow the sector more closely. As a new institution with responsibility for the sector and itself, Information and Communication Technologies Authority is characterized as an advanced institution with its technological and human resource structure, but it still has a long way to go in order to keep up with the dynamic structure of the sector. And this is done by industry stakeholders, universal service obligee Postal and Telegraph Corporation and it is suggested that the sector should do it interactively with the non-governmental organization Turkish Cargo, Courier and Logistics Operators Association. The dynamic structure and growing volume of the sector seem to have the potential to accommodate more players, but this growth will be possible with a market structure without unfair competition.
