Özet

This paper examines the possibility of recognising a single overarching human rights regime within the European Union (“EU”) context. It identifies two major issues towards realising this goal: the EU's accession process to the European Convention on Human Rights and the relationship between the Court of Justice of the EU (“CJEU”) and EU Member States' high courts. It is submitted that CJEU's relationship with high courts of EU Member States on the one hand and with the European Court of Human Rights (“ECtHR”) on the other leads to overlapping jurisdictions, yet the mutual dialogue and respect can balance the interests of different courts and therefore fits with the idea of constitutional pluralism. Thus, this essay positions itself against the EU's accession to the ECHR that meets all the concerns in the CJEU's Opinion 2/13 and proposes the current judicial dialogue and legal pluralism, enabling a multilevel human rights regime, benefits human rights protection better.
